BSB obtains civil restraint order against practising lawyer
Outer Temple barristers Mark Mullins and Gus Baker represented the Bar Standards Board (“BSB”) as part of a team which successfully defended a series of High Court appeals brought by Birmingham barrister Mr Tariq Rehman against findings of the Bar Disciplinary Tribunal. The BSB obtained a rare civil restraint order (CRO) against a practicing lawyer. In his judgment of 29 July 2016 Mr Justice Hickinbottom dismissed two of Mr Rehman’s appeals and went on to make an extended civil restraint order against Mr. Rehman for a period of two years. One of the appeals raised issues of wider application about the exercise of a professional disciplinary tribunal’s discretion to proceed in the absence of the accused professional.
