Barristers at Outer Temple Chambers act for claimants and defendants in all areas of professional negligence, whether by surveyors, accountants, financial advisers or insurance brokers.
Our commercial specialists are instructed in a broad spread of cases including commercial property transactions, international trade, sale of goods, partnership disputes, shareholders’ disputes, assignment of causes of action, corporate and personal insolvency.
We have particular expertise in professional negligence cases concerning occupational pensions, investment and financial services, and we have cross-examined witnesses in all manner of disciplines, from actuaries to dairy consultants.
Much of our work emanates from our core areas of practice. As a result, barristers in the professional negligence group have advised and appeared in cases concerning employment, clinical negligence, personal injury and mortgages.
We provide an advisory as well as an adversarial service, and advise claimants and defendants on all aspects of professional negligence matters, including limitation, liability, quantum and evidence.
Recent professional negligence cases in which members of Chambers have appeared or advised include Hogg Robinson Trustees Ltd v Scott Lang, a successful claim on behalf of pension scheme trustees against scheme investment advisers and fund managers for negligent investment advice.
As well as acting as advocates at all levels of civil first instance and appellate courts, members of the commercial team regularly appear at arbitrations and mediations, and several have professional qualifications in alternative dispute resolution.
We believe teamwork is essential in the litigation process, as is the need to build and maintain effective working relationships with professional clients.
Recent commercial cases in which members of Chambers have appeared or advised include the multi million pound international export finance case in the Commercial Court: Nederlandsche Creditverzekering Maatchappijnv & Anor v Dovertower & Ors; Ruttle Plant Hire Ltd v DEFRA; a mulit-million pound claim for breach of contract arising out of the foot and mouth outbreak in 2001 involving issues of interest due under the Late Payment of Commercial Debts (Interest) Act; and commercial litigation arising out of the Buncefield Oil Depot disaster.
