Alan Jenkins specialises in cases arising from alleged failures to follow appropriate procedures in the workplace, often where it is alleged that death or personal injury has resulted.

His practice focuses on the criminal, health and safety, and professional disciplinary allegations that might be made in such cases. He has over 20 years experience in defending cases of gross negligence manslaughter, and is regularly instructed to advise potential defendants prior to interview where such charges are being investigated. Many of the cases in which Alan has been instructed concern hospitals and medical practice; others have involved the industrial, construction, and social care sectors, and also deaths in custody. He also has extensive experience in the Coroner’s Court, usually instructed for one of the interested parties whose actions fall to be scrutinised.

Alan Jenkins has a background in criminal work, mostly defending professional people, in cases of fraud, regulatory or sexual offences. He has experience in serious fraud trials, often as a leading junior, in confiscation and other financial proceedings, and other serious crime cases: murder, rape, kidnapping etc. 

He has advised and acted for corporate clients in health and safety cases, in cases in the criminal and Coroner’s Courts, as well as proceedings before the Employment Tribunal (Prohibition notices).

He has huge experience in professional disciplinary cases, having appeared regularly (over the last twenty years) to defend in cases before the General Medical Council, the General Dental Council, and the Solicitors Disciplinary Tribunal. He has appeared in tribunals and advised in the fields of accountancy, psychology, nursing, hearing aid practitioners and the actuarial profession. His experience acting for doctors includes hearings before PCT’s, Hospital Trusts and appeals (Privy Council, Administrative Court, FHSAA, First Tier Tribunal etc).

  • R v Dr S 
  • Successfully defended GP on multiple charges of sexual assault, over two trials.  Leading Michael Uberoi of Outer Temple Chambers.  GP charged with 18 counts of sexual assault on a total of 12 female patients.  Jury in first trial acquitted on 7 charges, but were unable to agree on the remaining 11 charges.  Second jury acquitted on the outstanding counts.  The two trials, in March/April and September/October 2011, each lasted 4 weeks.


 

  • Re Dr X v Y NHS Hospital Trust 
  • Acted for Consultant in disciplinary proceedings brought by his employer.
     

 

  • Re Dr O
  • Acted for consultant radiologist in disciplinary proceedings with employing Trust.
     

 

  • GMC v Dr H 
  • Successfully defended consultant paediatrician in 5 week hearing before a Fitness to Practise Panel.  Doctor accused of misconduct concerning the care of a child who died.  His fitness to practise was found to be not impaired, and no warning was issued.

 

  • R v J
  • Successfully defended company director charged with fraudulent trading with regard to 2 companies and other offences of dishonesty.  Prosecution alleged £2m fraud on creditors and commercial lenders.  NG verdicts on all counts after 7 week trial. 

 

  • Re R Ltd
  • Acting for company against HSE.  Prohibition notice.

 

  • R v Ghadiali, and GMC v Dr Ghadiali
  • Acted for consultant psychiatrist accused of multiple sexual assaults on female patients.  Doctor acquitted on all counts in criminal courts, over two trials, at Nottingham and Leicester Crown Court.  Subsequent GMC proceedings in 2009 over 4 weeks.

  • Advising company following death of employee at work

 

  • R v Dr N
  • Successfully defended GP charged with manslaughter by gross negligence at Plymouth Crown Court.   NG verdict after 2 week trial.

 

  • Re Gosport War Memorial Hospital, and GMC v Dr Barton
  • Acted for Gosport GP who worked as clinical assistant at the Gosport War Memorial Hospital in 1990’s.  More than 90 deaths investigated by Police.  Appeared at inquest into 12 deaths at Portsmouth Coroners Court during March and April 2009.  Appeared at GMC during 12 week Fitness to Practise Panel hearing.  Conditions imposed by panel.

  • Successfully defended GP accused of sexual assaults upon 2 patients.

 

  • R v Dr G 
  • Successfully defended GP on allegations of fraud/dishonesty, leading Michael Uberoi of Outer Temple Chambers.  After 12 week trial at Kingston Crown Court jury acquitted on (all) 37 counts on the indictment.
