Abhijeet Mukherjee specialises in medical law. Called to the Bar in 1995, his practice covers clinical negligence, personal injury and professional disciplinary work.  He regularly ranks in the Chambers & Partners Legal Directory as a leading barrister in clinical negligence work and was recently described by solicitors as a barrister who 'is prepared to really fight for your client' and noted for his direct and effective style of advocacy.   

Abhijeet's clinical negligence practice covers the full spectrum of cases, ranging up to those of the utmost severity. He has a particular interest in cases involving obstetrics, surgery, orthopaedics, and psychiatry. Recent examples of his cases include:

  • advising a large number of families whose children were misdiagnosed with epilepsy in the 1990's in Leicester, with devastating consequences to the children involved.
  • obtaining significant compensation for a male patient who sustained damage to his only viable vas deferens following a hernia operation, resulting in him and his wife needing extensive IVF treatment to start a family
  • recovery of damages for a transsexual following complications during a gender reassignment operation at Charing Cross Hospital,  London

Abhijeet is also an experienced advocate in the Coroners' Court and recognises the importance of the inquest process to his clients. He was involved in the Britton case, which began with an inquest into the death of a patient in hospital following a lack of emergency equipment. The case resulted in the successful recovery of damages under the Human Rights Act 1998 for the patient's daughter, who would otherwise have not been able to recover compensation because of her circumstances.

An increasingly important amount of Abhijeet's practice is in professional discipline in which he specialises in defence work. He appears before the General Medical Council, the General Dental Council and the Nursing & Midwifery Council. He has represented both the Medical Defence Union and the Medical Protection Society. Abhijeet is particularly aware of the stressful nature of such proceedings to those individual professionals he represents.   

Abhijeet also has a strong personal injury practice in which his main areas of work are industrial disease, health and safety cases and road traffic accidents. His industrial disease caseload covers asbestosis and mesothelioma. He was also recently successful in recovering compensation for industrial deafness for a Claimant who was exposed to high levels of noise from working in textile mills in the 1970's.

Abhijeet regularly lectures to solicitors and members of the medical profession. His articles have also been published in the Times newspaper and in journals such as Clinical Risk. He is a member of Middle Temple and has professional membership with Action against Medical Accidents (AvMA) and the Professional Negligence Bar Association (PNBA).
