Hywel Jenkins' speciality is advocacy. This he practises in the areas of commercial fraud, personal injury, and regulatory and disciplinary where he has extensive experience in Health and Safety at Work cases. For example, he prosecuted the Southampton Hospitals Health Trust for failing properly to supervise their junior doctors, a landmark case in this area of the law. In this area, he has represented clients such as Balfour Beatty and prosecuted such defendants as Railtrack plc, where as Senior Counsel, he reported directly to the Attorney-General in the proposed prosecution of Railtrack and its officers over the Paddington Rail disaster. His Health and Safety at Work practice embraces cases of gross negligence manslaughter which he has both prosecuted and defended as both junior and leading counsel. Notable among these is R v Misra now one of the leading cases on the Mens Rea in gross negligence manslaughter.
His personal injury practice embraces largely, though not exclusively, catastrophic injury particularly where there are complex difficulties on liability. He appeared for the Claimant in Ratcliffe v Harper Adams, a case of catastrophic injury, now one of the leading cases under the Occupiers Liability Act 1984.
Hywel Jenkins also appears regularly before various disciplinary and professional tribunals such as the General Medical Council and the Hearing-aid Council, as well as being concerned on behalf of the RSPCA in cases involving animal welfare. He successfully defended a case in the VAT Tribunal Re C & E -v- Leovaris where as a result the client was awarded a refund of £100,000 vat.
Practising in commercial fraud, he appears regularly for both the S F 0 and the Fraud Prosecution Service and was recently instructed by the S F 0 on behalf of the government of Iran in an application to freeze the assets of a major international fraudster.
