Mark's practice covers employment and discrimination law, professional discipline and regulation, medical, healthcare and social services law, inquests and enquiries and judicial review.
In employment law he represents both claimants and respondents in the Employment Tribunal and on appeal. He has particular experience in representing local authorities, NHS organisations and other public bodies such as the fire and probation services and of cases involving allegations of unlawful discrimination, "whistle blowing" and senior officers.
In professional discipline he represents doctors and other health professionals before a range of regulatory bodies including the General Medical Council, the Nursing and Midwifery Council and the Health Professions Council, as well as presenting cases for the Bar Standards Board in the Bar Disciplinary Tribunal. In his regulatory work he advises and represents the Commission for Social Care Inspection, Healthcare Commission and registered providers in appeals to the Care Standards Tribunal under the Care Standards Act 2000.
Mark deals with medical and healthcare issues such as consent to treatment and the statutory duties and powers of NHS bodies, advising, making and responding to court applications and judicial review challenges. He is recognised as an expert in community care, mental health and mental capacity law and has a special interest in the safeguarding of vulnerable adults and children. He has appeared in leading cases at all levels including the House of Lords and works for many adult social services and children's services authorities.
He is also instructed in difficult and high profile inquests and enquiries, often in a health or social care context, which may involve mental health issues, police shootings, or deaths in custody and prison. He has appeared in a number of Article 2 ECHR inquests in recent years representing NHS Trusts, doctors and families. He was junior counsel to the Independent Monitoring Board in The Inquiry into the death of Zaid Mubarek 2004-5, a high profile public inquiry into racist murder of a young man in Feltham YOI. He is also available to chair internal disciplinary and other panels and inquiries.
Mark is a First Tier Tribunal Judge (Health and Social Care Chamber) and was a legal member of the Mental Health Tribunal from 1999 to 2009. He has a postgraduate diploma in Forensic Mental Health from St. George's Hospital Medical School, University of London. He has carried out training in human rights and monitoring visits to social care and mental health institutions in Bulgaria, Kosovo Hungary and Romania. He is an independent director of BaseballSoftball UK, the national development agency for the sports of baseball and softball in the UK.
