Robin Tolson specialises in all aspects of the law relating to children and families as well as public and administrative law. Reported cases in which he has been involved within the last 18 months include the decision of the Grand Chamber of the European Court of Human Rights in Natallie Evans' fight for the use of her stored embryos; Re: C in which the Court of Appeal explored the availability of damages for the breach of human rights within children cases; H v H on the validity of ‘quickie' Japanese divorces in the UK; the case of A County Council v DP, RS and BS exploring the limits of the power to seek findings in public law children's proceedings; Re: W on the use of section 7 of the Human Rights Act 1998 following the making of a care order; Re: B on the evidence required to establish non-accidental head injury in children; and J v C on the meaning and effect of a void marriage and who may be a "parent". In Re: CM Robin recently secured one of the first awards of damages for breach of human rights in a family case. Robin also acted for Tim Williams against Newport City Council in his recent successful and widely reported fight for the return of his 3 children from care. He acts for the parents in the ongoing civil litigation. Robin practices across the Country and is currently the leader of the Western Circuit.
