Where an appeal against a Determination of the Pensions Ombudsman raises issues that are of general importance or have implications for the jurisdiction of the Pensions Ombudsman the Court was not willing to allow the appeal to proceed where the Defendant did not appear and the Ombudsman had declined to appear or to be represented. The Judge has written to the Ombudsman urging him to attend at the adjourned hearing.
