Our experienced clerks will be pleased to provide you with more details of our expertise in this area.
Our members give advice which is practical, objective, helpful and clear. They adopt a strategic as well as a tactical approach to the client’s cause and seek to avoid expensive and time-consuming disputes, where possible. Where necessary, the range of expertise and skillsets of other barristers within Outer Temple enables us to draw on a pool of cross-over knowledge and relevant expertise.
Our tax barristers specialise in the provision of a range of tax advice and litigation services, whether for corporates or for private clients, including issues related to pensions and trusts and estates, VAT, customs and excise matters and offshore work.
Our team can, and do, appear as advocates before a range of UK and non-UK courts and tribunals, including in tax appeals and other tax-related litigation. They also provide independent advice (in conference or by telephone) or by written opinion and will draft key documents where necessary to implement that advice. They may be instructed by professional clients such as solicitors, legal consultants, accountants, or directly under the Bar’s Public Access scheme.
Particular areas of litigation expertise include: tax litigation involving national tax authorities at national and supra-national (eg EU) levels; statutory construction of tax legislation (primary and subordinate); broad expertise in all aspects of business tax litigation, including indirect taxes (VAT and excise duties); and extensive experience in civil tax fraud litigation, including EU MTIC (missing trader intra-Community) cases.
Our expertise in tax advice covers: taxation of expatriates; wealth, inheritance and gift taxation; charitable organisations; management packages; multinational corporate structuring; non-resident companies and trusts; tax recovery matters.
Our members are usually consulted on difficult or controversial points of law and often in relation to complex structures. As well as taxation expertise, some members are particularly experienced in areas such as business crime, financial services and pensions and trusts, which often relate to tax problems.
