Fraud and Extradition

Outer Temple Chambers has a national and international reputation in the highly specialised field of commercial fraud and the inter-jurisdictional issues of extradition, asset tracing and recovery and regulation of financial markets.

Members of chambers have recent and current experience, both advising on pre¬emptive actions which may avoid completely or mitigate the impact of proceedings, and, when proceedings arise acting for the prosecution or the defence.

We work with our clients to create a team with the skills the given case demands. With chambers’ experience in commercial, regulatory and public law, we are able to create highly specialised case teams which have the strength to master the most complex cases. Able to offer multi-disciplinary teams, Chambers can provide a full service to meet all the needs of our clients.

Overseas work has gained an ever greater prominence in the fraud and regulatory fields in which we specialise. Members of chambers work extensively in foreign jurisdictions and advise governments, banks, major institutions and individuals in connection with extradition, cross-border powers relating to arrest and asset recovery and the complex matrix of statutory provisions which reach far beyond our national borders.

Our track record in major commercial crime is well proven and members ofChambers have appeared in many high profile serious fraud cases including Guinness, Blue Arrow, Polly Peck, Barlow Clowes, Maxwell, Levitt, Wickes and most recently O’Neill.

Chambers has a long standing association with top level regulation both in the financial issues that involve the City of London but also the modernisation of professional regulation in medicine, accountancy, the law, and sport amongst other disciplines. As commerce becomes global so does its regulation and Outer Temple Chambers is concerned in many foreign jurisdictions – not least New York - with the policing of the banking and finance industry.

Chambers has a strong and growing association with the FSA for whom members work either directly instructed to advise and appear on a steady stream of complex issues, or, through secondment into both the organisation’s RDC and Enforcement divisions. Whether acting for or against the FSA, Chambers’ combination of skills makes us well suited to cater for the demands this type of work imposes.

A unique partnership with BDO Stoy Hayward’s Asset Investigation and Control Group in the field of asset recovery in the High Court and Court of Appeal demonstrates Chambers’ ability to offer teams of specialist barristers able to adopt a commercial approach and offer practical and sensible business solutions. This joint venture allows clients access to market leading specialists that is both time efficient and cost effective.

Chambers and Partners, 2008

Richard Lissack QC has a multitude of large fraud cases under his belt. A veteran of the SFO investigations into Maxwell and Gidney Securities, he has demonstrated his credentials when it comes to the pensions sphere, and also scores highly in pharmaceutical matters as evidenced by his appearance in such matters as Operation Holbein. Peers speak of a man who "sets his chin grimly against the opposition and tears them to pieces."

Although based at a set in London, two silks at Outer Temple Chambers thrive on the Western Circuit. Former leader of the circuit Philip Mott QC is "a name to conjure with." Dealing mostly with prosecution, much of it on the fraud side, he is viewed as "highly perspicacious - he sees through a case from the beginning and gets straight to the nub." Others note that "for an out and out legal type of case he's the best - he is a good academic lawyer who presents legal arguments well, both in writing and in court." Colleague Christopher Wilson-Smith QC "scores well once he gets his man in the box - woe betide the mendacious when Wilson-Smith takes them to task."  James Leonard merits "special mention".

Paul Garlick QC is recommended as a leading silk in extradition.
