Outer Temple’s Fiona Horlick KC has been appointed to the FA National Serious Case Panel for the forthcoming 2022-2023 football season. The National Serious Case Panel (NSCP) adjudicates on all types of Serious Cases within Grassroots Football including Assaults on and Threats to Match Officials, Assaults on Participants, acts of Victimisation and Disorderly Conduct at matches. The Abu Dhabi Global Market (“ADGM”) has issued a landmark decision in relation to the Court’s approach to governing law and jurisdiction clauses. Background In Mingguo v Sadeghnia [2023] ADGM CFI-021 the ADGM Court of First Instance considered its approach to the construction of governing law and jurisdiction clauses, specifying that disputes will be governed by the “Laws of the United Arab Emirates”. Whilst those questions have previously come before the DIFC Courts, there are no reported decisions in which the ADGM Court has considered its own approach to the construction of ambiguous governing law and jurisdiction clauses. The Court of Appeal has published its judgment in (1) Lawrence Ewan McGaughey (2) Neil Martin Davies (Claimants/Appellants) -v- Universities Superannuation Scheme Ltd (First Defendant/First Respondent), the landmark company multiple derivative case which raised the question of directors’ duties in relation to divestment in fossil fuels for the first time. Discrimination law specialist Naomi Cunningham was invited to write an article for Discrimination Law Association Briefings on the Scottish court ruling on the meaning of ‘sex’. Naomi’s article highlights the issue that, under the Scotland Act 1998 (the Act), any provision of legislation passed by the Scottish Parliament is of no effect in so far as it is ‘outside the legislative competence of the Parliament’; a provision is outside the legislative competence of the Parliament if it relates to reserved matters. Oliver Powell and Alex Haines – instructed by arbitration specialists David Pusztai and Veronika Korom, adjunct professor and professor respectively – appeared in a 10-day International Centre for Settlement of Investment Disputes (ICSID) arbitration for the Shareholder Claimants in PNB Banka and others v. Republic of Latvia (ICSID Case No. ARB/17/47) pursuant to the Bilateral Investment Treaty between Latvia and the UK. The legal team was assisted by Kalman Varga, junior associate. The merits hearing took place between Monday 26 June and 7 July 2023 at the International Dispute Resolution Centre (IDRC) in London. Alex Haines and Carin Hunt are to proceed to a substantive hearing of the merits of their client’s indirect sex discrimination claim against her employer, the International Bank for Reconstruction and Development (IBRD) of the World Bank Group. This will be the first claim of its kind to be heard by the World Bank Administrative Tribunal (“the WBAT”) – an International Administrative Tribunal similar in nature to the United Nations Appeals Tribunal and the International Monetary Fund Administrative Tribunal – which sits in Washington DC.
