Outer Temple Chambers is delighted to welcome Abhi Mukherjee, a former member of Chambers as Professional Associate to our personal injury and clinical negligence team. Abhi Mukherjee is now based in Melbourne, Australia. He joined the Victorian Bar in Australia in 2013 after relocating to Melbourne. Abhi specialises in medical law, industrial disease and personal injury. Since commencing practice as a barrister in Australia, he has been mainly involved in clinical negligence cases, professional disciplinary matters and representing interested parties at coronial inquests including bereaved families and healthcare professionals. David Russell KC, Philip Punwar and Sean Yates provided training at the DIFC Laws & Courts Procedures, a unit of the DIFC Laws Certificate Programme 2024, that took place between 7th May and 16th July 2024 at the DIFC Academy. The DIFC Academy, in Association with Middlesex University Dubai and Outer Temple Chambers present the sixth edition of the DIFC Laws Certificate taking place between May to October 2024. This 6-month programme consists of nine units. The Court of Appeal has dismissed the BBC’s appeal and has held that the BBC fetter protects future service benefits. Andrew Spink KC and Saul Margo acted on behalf of the successful Representative Beneficiary. The Court of Appeal has handed down its judgment in British Broadcasting Association v (1) BBC Pension Trust Limited (2) Christina Burns. In upholding the decision of the High Court, this landmark decision is the second case (after Lloyds Bank Pension Trust Corporation v Lloyds Bank plc [1996] PLR 263) in which a domestic court has found that a fetter on a pension scheme’s amendment power protects future service benefits. In Clayson and others v Ministry of Justice and others [2024] EAT 99, the Employment Appeal Tribunal (Mr Justice Kerr) dismissed an appeal brought by Claimant Circuit Judges in relation to their pension rights. Andrew Allen KC and Alexander Line successfully represented the Respondents. The three test Claimants (who formed part of a larger cohort) were each former Recorders who were appointed to the office of Circuit Judge on or after 31st March 1995. That date was important, as it was the date on which a new judicial pension scheme under the Judicial Pensions and Retirement Act 1993 (‘JUPRA’) came into effect. The Employment Appeal Tribunal has handed down judgment in the case of NSL v Zaluski, in which Lydia Seymour and Elizabeth Grace successfully acted for the Appellant. The Employment Appeal Tribunal has handed down a detailed judgment overturning an Employment Tribunal’s finding of indirect race discrimination in relation to an employer’s annual leave policy during the Covid pandemic. The EAT also overturned an award of aggravated damages but upheld a finding of harassment related to race. In NSL v Zaluski [2024] EAT 86, the employer adopted an annual leave policy during the pandemic which required employees to factor in any relevant period of quarantine as a result of the pandemic.
