Will Young successfully represented the claimant in a clinical negligence claim for £500,000 arising out of a negligent failure. Will was instructed by the Claimant in a clinical negligence claim arising out of a negligent failure to diagnose Giant Cell Arteritis, leading to virtual blindness in one eye. The Claimant attended hospital complaining of headaches and various other symptoms. The diagnosis of GCA was not adequately considered, with the result that the Claimant was not given appropriate steroid treatment, which would have avoided the subsequent deterioration in her vision. The Claimant, who was retired, suffered significant visual loss (amounting effectively to blindness) in one eye, resulting in a need for care and assistance, as well as accommodation adaptations and equipment.…

Outer Temple’s Will Young has recently settled a brain injury claim for £525,000 as a result of a road traffic accident. Will was instructed by the Claimant in a case involving a cycling accident leading to brain injury. The Claimant was struck by a lorry driven by the Defendant’s employee when riding her bicycle. She suffered a traumatic brain injury, including a fractured skull leading to a craniotomy. Thankfully she made a good recovery, given the severity of the original injury, although it was complicated by significant psychiatric and psychological symptoms. Alex Line, instructed by the government legal department, recently represented the Secretary of State for Education in Averre-Beeson v Secretary of State for Education [2024] UKFTT 00385 (HESC). This was an appeal under s.129 of the Education and Skills Act 2008, which went to the Health, Education and Social Care Chamber of the First-tier Tribunal (in its Care Standards jurisdiction). These were long running proceedings emanating from a high profile and widely reported collapse of a large multi-academy trust. The Appellant, a well-known figure in the schools industry, held various positions of responsibility within the trust. On 22 May 2024, the Court of Appeal handed down its judgment in İşbilen v Turk [2024] EWCA Civ 568 in which James Counsell KC and Helen Pugh were instructed. James Counsell KC and Helen Pugh acted successfully for their client, Selman Turk in his appeal against the immediate custodial sentence for Contempt of Court imposed by the High Court. In this long-running, complex civil fraud case, the defendant was found in contempt of court for breaching disclosure obligations ancillary to a proprietary injunction aimed at recovering funds allegedly misappropriated from the claimant. He has served on previous Arbitration Panels for them for several years. The Times has named Naomi Cunningham ‘Lawyer of the Week’ after she acted for social worker Rachel Meade in an employment tribunal claim against both her employer, Westminster City Council, and her Regulator, Social Work England. Ms Meade had been sanctioned by Social Work England and then suspended on a charge of gross misconduct by the Council after a Facebook friend presented a dossier of her “gender-critical” posts to her regulator. The tribunal found that the regulator had “allowed its processes to be subverted to punish and supress the Claimant’s lawful political speech”. Courtney Step-Marsden successful in EAT appeal regarding the liability of individually named respondents under Section 110 Equality Act 2010. Naming individual employees as respondents to employment tribunal proceedings is a common issue, particularly in circumstances where the employer is not seeking to run the defence as outlined in s,109(4) Equality Act 2010. However, the recent judgment of Baldwin v Cleves School reminds us that, on a correct construction of s.109 and s.110, an employment tribunal does not have discretion to find that the named respondents are not liable for their own acts of discrimination.
