Justina Stewart will Chair a panel discussion on ‘Recent Developments and Future Trends in the Regulation of Cryptoassets’, hosted by the Financial Services Lawyer Association (FSLA) on Tuesday 18th February 2025 at DAC Beachcroft LLP, London. Oliver Lawrence defeats non-compete injunction in the High Court

Oliver Lawrence successfully represented the Defendant before HHJ Watson (sitting as a High Court Judge) in Birmingham. The application for a non-compete injunction was brought by a catering company against one of its former managers. The injunction sought would have prevented the employee from working for a competitor for six months after the termination of his employment. The main issue in the case was whether the non-compete covenant was drafted too broadly to be enforceable. It was found to be too wide. The contractual wording was insufficient to tie the prohibited activities to the sector of the former employee. The absence of a geographical restriction meant that the non-compete operated globally. Ben Bradley succeeds in hypoxic brain injury claim arising from PEG procedure

Ben Bradley successfully represented the Claimant following a 6-day trial before HHJ Kelly (sitting as a High Court Judge) in Birmingham. The trial revolved around a PEG Procedure performed by a Consultant Gastroenterologist at the Good Hope Hospital in Sutton Coldfield in 2016. The Claimant had a complex pre-existing medical history, having suffered congenital cerebral palsy from birth. Following the index PEG procedure, she became unwell. It soon became apparent that her stomach wall had become necrotic at the site of the procedure. She developed four-quadrant peritonitis as a result. She remained in intensive care for 4 months following reparative surgery and suffered a serious deterioration in her function thereafter, resulting (amongst other things) in a significant increase in her…

Andrew Short KC, Paul Livingston & Victoria Brown successful in equal value stage of Asda’s equal pay claim

The Employment Tribunal handed down judgment on Friday 31st January 2025 in the landmark equal pay claim for Asda workers. Andrew Short KC, Paul Livingston and Victoria Brown, instructed by Leigh Day, acted for the Claimants. The ET found in favour of 12 female lead claimants, represented by Andrew, Paul and Victoria, determining that they have established equal value with at least one of the male comparators. Asda’s female workers launched their claim in 2014 against their employer based on the fact that the predominantly female retail workforce is paid less than the predominantly male depot workforce per hour. In Gregory & Stroilov v (1) Judicial Conduct Investigations Office (2) Judicial Appointments and Conduct Ombudsman [2025] EWHC 201 (Admin), Dove J refused permission for the Claimants to proceed with their judicial review claim. Alex Line represented the First Defendant, against whom five of the six judicial review grounds relied on were against. The First Claimant is the father of Indi Gregory, who was terminally ill and tragically passed away in 2023 following the implementation of a care plan permitting the withdrawal of life support treatment. Louis Weston acted for the Badminton World Federation (BWF) in the prosecution of Liew Daren and Jerry Gan for betting offences under the Rules of the BWF. Head of Outer Temple’s Sports Law team, Louis Weston represented the Badminton World Federation at an Independent Hearing Panel where former Malaysian badminton player Liew Daren and former National Sports Institute (ISN) performance analyst Jerry Gan were found guilty of betting violations and match-fixing. The case followed a hearing in Malaysia in May 2021, in which the Coach and Analyst were found to have bet on a series of badminton matches discovered by messages between them on phones. Clinical negligence and international injuries specialist, Ian Denham, co-authored an article, “Medical Tourism and Package Travel Regulations” with Polina Sokolovska (formerly of Stewarts), which was recently published in the Journal of Personal Injury Law. The article considers whether medical procedures and treatments could fall within the scope of the Package Travel Regulations and, if so, what guidance there may be establish by what standards such treatment should be assessed and whether liability might be established against a tour operator. Medical tourism is an expanding global industry with a growing number of UK residents traveling to undergo medical and cosmetic procedures abroad. Louis Weston acted for the Darts Regulation Authority (DRA) in the prosecution of Leighton Bennett and Billy Warriner for numerous breaches of the DRA Rules, including match fixing. Louis, the Head of Outer Temple’s Sports Law Group acted for the Darts Regulation Authority in the case of Leighton Bennett and Billy Warriner. The case involved the rising star Leighton Bennett (aged 17) agreeing to fix a series of matches which were then bet on by Billy Warriner. After investigations following reported suspicious betting at a series of matches, the DRA Disciplinary Committee found both players guilty of the breaches of the DRA Rules.
