On 8th January 2024, Alex Haines was admitted to the Washington DC Bar.  The majority of Alex’s international practice relates to the International Organisations headquartered in Washington DC, namely the World Bank Group, the International Monetary Fund (IMF), the Inter-American Development Bank (IADB), the Organization of American States (OAS) and the Pan American Health Organization (PAHO).  Alex is also admitted to the New York Bar (2019) and the Irish Bar (2020), as well as called to the Bar of England and Wales (2007). Naomi Cunningham appeared in the Edinburgh employment tribunal for a counsellor complaining against Edinburgh Rape Crisis Centre of discrimination, harassment and constructive dismissal on grounds of her protected ‘sex-realist’ belief. Naomi represented Roz Adams, who was accused of being ‘transphobic’ after she consulted a ‘non-binary’ colleague, AB, about how she could reassure a client assigned to AB that AB was not a man. Managers insisted that it was contrary to policy to disclose the sex of any worker to a service user, although service users could be told that no men were included in its staff or volunteer team. The Court of Appeal has provided an authoritative guide to the procedure required to find a debtor in contempt under Part 71 of the Civil Procedure Rules following an appeal concerning contempt of court in which Jeremy Scott-Joynt successfully acted for the appellant. In its judgment, handed down on 22 December 2023 under neutral citation [2023] EWCA Civ 1566 following a hearing on 19 December, the Court considered what ought to happen where a judgment debtor did not appear before the Court when ordered to do so under Part 71 – but where personal service had not been undertaken. Fiona Horlick KC successfully acted for the appellant in his appeal against an order for committal to prison for contempt of court in the Court of Appeal on 12 December 2023. The judgment is now available [2023] EWCA Civ 1504. Fiona had not acted for the appellant at the original hearing but was instructed at short notice for the appeal.  The judgement reiterated the fundamental importance of the correct procedure being followed in contempt proceedings. The appellant had been a designated member of an LLP.  Committal proceedings were brought against the LLP only.  However, the original judge wrongly found that she had could adjudicate on a contempt allegation against the appellant personally. Alex Haines and Henry Reid were instructed by the Applicant in a case that came before the African Union (“AU”) Administrative Tribunal for a final hearing on 16th and 17th November 2023. The AU Administrative Tribunal, an international administrative tribunal – similar in nature to both the World Bank Administrative Tribunal and United Nations Dispute Tribunal – is based in Addis Ababa, Ethiopia. Judgment is expected early next year.
