Michael Uberoi practises in commercial and regulatory litigation, with a particular focus upon pensions and financial services. The 2021 Legal Directories describe him as “very dynamic and bright”, state that “he has very thorough and well-founded knowledge, and he is very practical and very client-friendly” (Pensions, Chambers & Partners, Leading Junior), and describe him as “personable, technically outstanding, and very hard working and responsive” (Financial Services Regulation, Legal 500, Leading Junior). They also describe him as “an exceptional advocate”, who is “very, very hard working”, and as a “bright junior with a strong intellect and good judgement”.

Some recent pensions cases include: Univar v Smith & Ors [2020] EWHC 1596 (Ch) (rectification / collateral contracts / estoppel – Univar was the first contested pensions rectification action in eight years); Safeway Ltd v Newton (Cases 1 and 2 in the Court of Appeal, and in the CJEU- [2020] EWCA Civ 869; [2017] EWCA Civ 1482 – construction and equalisation); Sheffield v Kier Group plc [2019] EWHC 986 (Ch) (jurisdiction of the Pensions Ombudsman); Smith v Sheffield Teaching Hospitals NHS Foundation Trust [2018] PLR 5 (maladministration of benefits). Some ongoing pensions cases include: acting for individual trustees and board members in relation to proceedings brought regarding the Bic UK Pension Scheme; advising 51,000 scheme members in relation to how a state integration rule was incorporated in the rules of the scheme of a major Bank; defending a claim for rectification brought by a major multi-national Company; and acting for a major SIPP provider in relation to a group action of SIPP mis-selling claims.

Michael appears in all courts (both as sole and junior counsel) and is frequently instructed to obtain or resist interlocutory relief. Recent examples include: successfully obtaining a freezing injunction over assets totalling £3 million; successfully resisting an application for a mandatory injunction in a dispute between company directors; and successfully resisting an application to convert an interim anti-suit injunction into a final injunction. He has particular expertise in cases involving the interaction between financial services regulation and commercial litigation (Lampo v Royal Bank of Scotland [2016] EWHC 3824).

Michael sits on the Education & Training Sub-Committee of the Association of Pension Lawyers. He is a member of COMBAR, and is registered with the Dubai International Financial Centre. He is also called to the Bar of Northern Ireland.
