Tim Nesbitt QC has a practice focusing in the areas of commercial, regulatory and public law.
Tim’s brings to his practice in these areas qualities as an adviser and advocate that are consistently recognised by professional clients and directories, who especially cite his skills as an advocate, powers of legal analysis and his tenacity and commitment to his client’s cases.
The regulatory work Tim undertakes prominently includes defending and advising solicitors in connection with SRA/ SDT proceedings, defending medical professionals, financial services law, health and safety work, and acting for corporations in various particular industries facing their own regulatory environments, with particular emphasis on the commercial transport sector.
Tim is particularly well known for his work acting for solicitors in the Solicitors’ Disciplinary Tribunal, in relation to which he has acted in some of the most substantial cases in recent years.
The commercial work Tim undertakes is often linked to the regulatory fields in which he practices, but Tim also has over 25 years experience acting in general commercial cases. Tim also undertakes significant arbitration work, and accepts instructions to act as an arbitrator. Following a series of cases he worked on before taking silk (in 2018) Tim has a particular interest in cases involving claims of constructive trusts in relation to property.
Tim’s work in the financial services sector has included a recent extended period advising the Financial Conduct Authority on issues relating to the financial crisis in 2008 and assisting in the drafting of new rules relating to the regulation of the consumer credit industry.
In addition to his regulatory and commercial work Tim has undertaken public law for many years. The particular focus of his public law work in recent years has been in relation to the Court of Protection as part of the Outer Temple COP team, and he appears very regularly for Local Authorities and other parties in COP proceedings.
