Settlement followed a previously unsuccessful mediation in April 2022. The Claimant issued proceedings and continued to build his quantum case, including amongst other things, claims for single-storey accommodation, loss of earnings (on the basis that he had lost the opportunity to grow his business) and claims for specialist equipment (including a low gravity treadmill and various mobility support devices – whilst not full ‘exoskeletons’ such devices proved, following trials to improve the Claimant’s mobility and general ambulatory function).
Following the Defendant’s instruction of Leading Counsel, the matter settled at a subsequent mediation. Ben acted without a leader throughout the proceedings.
