Following their win before the OAS Administrative Tribunal in the case of Griner v Secretary General of the OAS Judgment 169 (31st August 2022), Alex Haines and Victoria Brown have secured another victory in the case of LaGuerre v Secretary General of the OAS, Resolution 413 (21st October 2022). After Mr LaGuerre’s case had been filed in March 2022, the OAS filed two motions: “Motion to dismiss the case in its entirety for being frivolous and failing to make a claim upon which relief can be granted”. “Motion in support of imposition of the filing fee therefore denying and dismissing the Complainants request for a waiver of said filing fee with prejudice”. Philip Stear will be live-streamed on the Court of Appeal YouTube channel on Thursday 1st December when he represents his appellant (defendant) clients in Jennison v Jennison & anr. The appeal relates to an important point in the Conflict of Laws as it relates to the administration of estates, namely whether the executor of a person who died domiciled abroad but owning property in England & Wales can commence proceedings on behalf of the estate before obtaining an English probate (or the resealing of the overseas grant). Alex Haines (Outer Temple Chambers) and Camila Zapata Besso (Doughty Street Chambers) successfully represented an individual in an international disciplinary case of alleged misconduct brought by the Ethics Office of the Inter-American Development Bank (‘IADB’), a regional Multilateral Development Bank and International Financial Institution headquartered in Washington DC. The mandate of the IADB’s Office of Institutional Integrity is limited to investigating external parties only. For former Bank staff members (such as the client in this case), however, the Ethics Office has jurisdiction to investigate and bring cases of alleged misconduct. Head of Chambers, James Counsell KC will be attending (remotely) the DIFC Laws Certificate Programme Awarding Ceremony on behalf of Outer Temple Chambers on Tuesday 13th December 2022. The DIFC Laws Certificate Programme is a course organised by the DIFC Academy. Over the course of a 7-month programme, it aims to provide education and training in common law and DIFC laws and courts procedures to civil law lawyers, DIFC Courts practitioners, Emirati advocates, In-house counsel and other professionals whose work involves exposure to common law systems and jurisdictions. There are three parts to the Advanced Advocacy course given by Outer Temple Chambers barristers, each part over two days. Joshua Hitchens was instructed by Janes Solicitors to represent the Defendant in contempt proceedings before Mr Justice Nicklin, who described the case as “a sobering reminder of the obligation on parties’ lawyers to read very carefully and to understand the effects of injunction orders”. The Defendant was subject to an injunction which restricted his use of the Claimant’s documents in proceedings. On 11th November 2022 the Court of Appeal gave judgment in Hinduja v Hinduja. John McKendrick KC acted on behalf of the first and second respondent. On 11 November 2022 the Court of Appeal gave judgment in Hinduja v Hinduja [2022] EWCA Civ 1492 and permitted press reporting of proceedings which began in June 2020. The proceedings relate to the property and welfare of Srichand Hinduja, the eldest of the four Hinduja brothers. Court of Protection In two judgments delivered in August 2022, (Hinduja v Hinduja [2022] EWCOP 36 and Hinduja v Hinduja [2022] EWCOP 37), Mr Justice Hayden lifted nearly all reporting restrictions in the case. Andrew Short KC and Bianca Venkata, acting for the claimants, and Naomi Ling, acting for the Trustee, have appeared in an important case relating to age discrimination in pension schemes. Mrs Justice Eady, President, sitting in the EAT, found that claimants bringing claims of age discrimination against a private sector body after IP Completion date (31 December 2020) could not rely on general principles of EU law to disapply a provision [in the Equality Act (Age Exemptions for Pension Schemes) Regulations 2010] excluding all claims for age discrimination relating to pensionable service before 1 December 2006. Outer Temple are pleased to share that our Junior Clerk, Jack Brown, has been shortlisted in the ‘ProBono Chambers’ Professional of the Year’ category at the 2022 Bar Pro Bono Awards. In his role as a member of the clerking team, Jack facilitated a significant amount of Pro Bono Work between members of the public and members of Chambers over the past year. Outer Temple Chambers warmly congratulates Sarah Crowther KC on her appointment as independent Judicial Chair of the British Horseracing Authority Judicial Panel. Sarah’s appointment will begin in January 2023 and she succeeds HH Brian Barker CBE KC. Further details of the BHA independent Judicial Panel can be found here.
