Ian Denham to represent the family of a child who died following a holiday to Turkey

Ian Denham has been instructed by Jatinder Paul, Senior Associate Solicitor in the International Serious Injury team at Irwin Mitchell, to represent the family of a two-year-old girl who died after she contracted a bacterial infection following a holiday to Turkey. Miss Birchall suffered gastric illness including stomach cramps and diarrhoea shortly after she returned from a 10-day stay in Antalya with her family. She was admitted to hospital, where she was diagnosed with Shiga-Toxin producing E.Coli (STEC).  She subsequently developed Haemolytic Uraemic Syndrome (HUS), a serious and potentially fatal blood condition linked to STEC, which can result in kidney failure and brain damage.  She sadly died on 3 August 2019. Major victory for the Tesco equal pay claimants represented by members of Outer Temple Chambers

The Court of Justice of the European Union gives important judgment in favour of several thousand female and male workers represented by Keith Bryant QC, Naomi Cunningham, Stephen Butler and Chloë Bell (instructed by Harcus Sinclair UK Limited, part of Harcus Parker) bringing equal pay claims against Tesco. This is a seminal judgment on the scope of equal pay protections to which workers in England and Wales must now be entitled in domestic courts and tribunals; Article 157 TFEU has direct effect in equal pay claims based on work of equal value. Elaine Palser acts for successful Inheritance Act claimants in the High Court

Elaine Palser, instructed by Tees Solicitors, acted for the successful claimants in R Deceased [2021] EWHC 936 (Ch). The claim was brought by two minor children for reasonable financial provision from their father’s estate under the Inheritance (Provision for Family and Dependants) Act 1975. The children were 14 and 15 when their father died, and they had been estranged from him for several years before his death.  Their father had also failed to pay any maintenance for them during the estrangement, with the children instead relying entirely on their mother and stepfather. Judgment in franchise dispute; Dwyer (UK) Franchising Ltd v Fredbar Ltd & Bartlett

Judgment was handed down last week in the case of Dwyer (UK) Franchising Ltd v Fredbar Ltd & Bartlett [2021] EWHC 1218 (Ch). David E. Grant acted for the Defendants in this expedited trial on liability and injunctive relief between a franchisor and ex-franchisee. Judgment was handed down in this franchise dispute on 11 May 2021. The First Defendant was a franchisee of the “Drain Doctor” brand licensed by the Claimant, Dwyer (UK Franchising) Ltd, which claimed to be the UK’s largest full-service network of emergency plumbing and drainage operations and part of the world’s largest home service franchise. Tim Nesbitt QC

It is with great sadness that we announce the untimely death of our friend and colleague, Tim Nesbitt QC. Tim was not only a very fine lawyer, but a person of huge decency, graciousness and humour who was always modest about his own exceptional abilities and generous with his time in supporting his colleagues in Chambers, with particular encouragement and support for those at the start of their careers.  His loss will be felt profoundly. David Holloway reappointed to the China International Economic and Trade Arbitration Commission Panel of Arbitrators

David’s reappointment is effective 1 May 2021. The China International Economic and Trade Arbitration Commission (CIETAC) was established in April 1956 under the China Council for the Promotion of International Trade. Since 2000, it has also been known as the Arbitration Court of the China Chamber of International Commerce. CIETAC is based in Beijing and has a number of sub-commissions throughout China, including in Shanghai, Shenzhen and Tianjin, as well as a Hong Kong Arbitration Center, which was set up in 2012. Commission advises EU to say No to Lugano Accession

Yesterday, the European Commission published its assessment of the UK’s application to accede to the 2007 Lugano Convention. The Commission advises the EU to reject the UK’s application to join the Convention for two key reasons. First, the Commission notes that those non-EU countries which have acceded to the Lugano Convention “all participate, at least partly, in the EU’s internal market” – this being by way of the EEA agreement for Norway and Iceland, and a number of bilateral trade agreements for Switzerland. This economic link, or “high degree of economic interconnection”, between those third countries and the EU’s internal market, says the Commission, is a key basis for their accession to the Convention.  By contrast, the Commission says, the…
