Daniel Barnett appears in leading agency workers’ case

Daniel Barnett acted for the Claimant in Angard & Royal Mail v Kocur, a decision of the Employment Appeal Tribunal handed down in December 2020. Mr Kocur was an agency worker, supplied to the Royal Mail by its wholly owned subsidiary employment agency Angard Staffing Solutions.  He brought a number of claims, which have previously been ruled upon by the EAT and Court of Appeal.  This latest appeal rolls up multiple legal issues on the rights of agency workers under the Agency Worker Regulations 2010. Alex Haines and Victoria Brown instructed to appear at the World Bank Administrative Tribunal in Washington DC

Two members of Outer Temple’s International Organisations Law Team instructed in cases before the World Bank Administrative Tribunal in Washington DC. Alex Haines and Victoria Brown have been instructed in two cases before the World Bank Group’s Administrative Tribunal (WBAT). The WBAT was established by the Board of Governors of the Bank in 1980. It acts as a judicial forum of last resort for the resolution of cases submitted by World Bank Group staff members alleging non-observance of their contracts of employment or terms of appointment. The WBAT’s decisions are final and binding on the Bank. The WBAT is composed of seven judges, all of whom are nationals of difference Bank Member States. The WBAT is governed by its Statute…

Equalising for the effect of unequal GMPs: Lloyds transfers Judgment

Andrew Short QC and Nicholas Hill acted for the Representative Defendant in this long-awaited and much anticipated case confirming the scope of the obligation to equalise for the effect of unequal GMPs following transfers out. In 2018 the first Lloyds Judgment [2018] EWHC 2839 (Ch) confirmed, over 20 years after the obligation arose, that pension schemes had to equalise benefits for the effect of unequal GMPs. The 2018 Judgment did not address the position of trustees of pension schemes where a member had transferred out and the trustees had made a transfer payment. In circumstances where the payment made failed to reflect the value of the member’s equalised benefits the unanswered question was whether the trustees remained under an obligation…
