Robert Rhodes QC appointed to Panel of Mediators of the International Commercial Mediation Center for the Belt and Road Initiative

We are delighted to announce that Robert Rhodes QC has been appointed to the Panel of Mediators of the International Commercial Mediation Center for the Belt and Road Initiative. The International Commercial Mediation Center for the Belt and Road Initiative is a world-leading dispute resolution service,  well suited to disputes that arise in relation to the Belt and Road development strategy, to promote economic co-operation along proposed Belt and Road routes. The Belt and Road initiative aims to build connectivity and cooperation between China, the land-based Silk Road Economic Belt, and the 21st Century Maritime Silk Road. John McKendrick QC appears in significant international mental capacity proceedings

John McKendrick QC appears in the case of Re AB, to determine whether or not to accede to a mother’s application for the English courts to recognise a foreign protective measure in respect of her incapacitated daughter. In Re AB [2020] EWCOP 47 the Senior Judge of the Court of Protection, HHJ Hilder was required to apply Schedule 3 of the Mental Capacity Act 2005 (“MCA”) to determine whether or not to accede to a mother’s application for the English courts to recognise a foreign protective measure (a guardianship order made by the New York courts) in respect of her incapacitated daughter. FCA drops probe into Bank of England ‘audio hack’

Michael Bowes QC advised Encoded Media on the FCA investigation into whether technology was misused by the company. This investigation was recently covered by the Financial Times. Michael Bowes QC advised Encoded Media, a UK technology company, in respect of an FCA investigation into whether technology used by the company to broadcast comments at press conferences given by the then governor of the Bank of England, Mark Carney, was somehow misused because it allegedly allowed some traders to hear the comments up to eight seconds faster than rivals watching on slower television feeds. Sarah Crowther QC and Chloë Bell secure £14.5 million settlement on behalf of a client with catastrophic injuries

Sarah Crowther QC and Chloë Bell recently represented a client in the High Court, who suffered catastrophic injuries caused by a road accident in France. The court recently approved a settlement of £14.5 million, which is thought to be one of the highest ever French law awards approved by an English court. Sarah and Chloe Bell were instructed by Mark Lee, partner and head of the travel law team at Penningtons Manches Cooper and were able to advise on the intricacies of French law. The case raised novel questions on the treatment of third-party payments to UK resident injured parties under French law assessment principles. Paul Livingston appears in Public Inquiry virtual hearing on child sexual exploitation by organised networks

Paul Livingston appears this week in the substantive hearing in the Independent Inquiry into Child Sexual Abuse’s investigation into Child Sexual Exploitation. The hearing – which is being conducted entirely remotely – examines institutional responses to child sexual exploitation by organised networks in England and Wales. Sexual exploitation of children is a form of child sexual abuse involving exploitative situations, contexts and relationships where a child receives something, as a result of sexual activities. An ‘organised network’ involves two or more individuals who are known or associated with one another, and known to be involved in or facilitate the sexual exploitation of children. The hearing is primarily looking at six areas: Durham, Swansea, Warwickshire, St Helen’s, Tower Hamlets and Bristol.…

Adeola Fadipe and Ian Browne begin pupillage

We are delighted to announce that our new pupils, Adeola Fadipe and Ian Browne, have begun pupillage at Outer Temple Chambers. Adeola Fadipe Adeola is currently supervised by Robert Dickason and Will Young in a seat focused on clinical negligence. Adeola graduated from the University of Hull with a first class in Law with Criminology. She successfully completed the Bar Course with a Very Competent, from City University. Prior to commencing pupillage, Adeola volunteered with the charity IPSEA, representing parents of children with special educational needs and disabilities at the First-tier Tribunal. Practical Law (Pensions); “Univar v Smith; first contested pensions rectification trial in 8 years”

Judgment was recently handed down by the High Court in Univar v Smith & Ors. Michael Uberoi’s article looking at some of the key issues in the judgment has been published in Practical Law (Pensions). Univar v Smith & Ors [2020] EWHC 1596 (Ch) was the first contested application for the rectification of pension scheme documentation for over eight years, and was also the first judgment by the High Court to apply the Court of Appeal’s new, subjective test for rectification, as declared by Leggatt LJ in FSHC Group Holdings Ltd v GLAS [2019] EWCA Civ 1361.
