New appointments to Attorney General’s Panels of Junior Counsel to the Crown

We are delighted to announce new appointments to the Attorney General’s A and C panels. Naomi Ling joins the A Panel, Rob Dickason joins the B Panel and four members of Chambers have been added to the C Panel. Naomi Ling joins the Attorney General’s A Panel, recognising her considerable expertise in employment and pension law. The A Panel deals with the most complex government cases in all kinds of courts and tribunals. Members will often appear against QCs. In general, those appointed to the A Panel will have over 10 years’ advocacy experience. Announcement of plans for synthetic LIBOR: panacea or pandora’s box?

John McKendrick QC, Justina Stewart and Chloë Bell write in the latest edition of the Journal of International Banking & Financial Law on potential public law implications of the UK Government’s plans for synthetic LIBOR to address tough legacy contracts. Plans announced in June 2020 to give the FCA enhanced powers to tackle “tough legacy” LIBOR contracts using “synthetic LIBOR” are intended to apply to a “narrow pool” of contracts.  It is still unclear how such contracts will be defined, whether the pool will in fact be narrow and how precisely the legislation and enhanced FCA powers will operate in relation to such contracts. Successful pro bono representation before the Financial Ombudsman

Chloë Bell has successfully provided pro bono representation before the Financial Ombudsman through Advocate, the Bar’s national charity for free legal assistance from volunteer barristers. Chloë Bell has provided pro bono representation to an individual who suffered a shortfall in a pension transfer quotation due to negligent advice and services provided by his financial advisors. The individual’s advisors sent incorrect documentation to the entity responsible for providing the quotation. When the correct documentation was eventually provided the original quotation had expired and the individual’s guaranteed minimum value quotation was lower. Representation was provided (through Advocate) before the Financial Ombudsman. Olinga Tahzib appears in virtual public hearing to examine child protection in religious organisations and settings

Olinga Tahzib appears this week in the second stage of the substantive hearing in the Independent Inquiry into Child Sexual Abuse’s investigation into Religious Organisations and Settings. The hearing – which is being conducted entirely remotely – examines child protection policies and practices in religious organisations in England and Wales. These include Jehovah’s Witnesses, Baptists, Methodists, Islam, Judaism, Sikhism, Hinduism, Buddhist and non-conformist Christian denominations. Yesterday, Olinga examined PR-A5, a former member of the Jehovah’s Witnesses, who was abused as a child by Peter Stewart, a ministerial servant within the congregation. Court of Appeal upholds that tragic Egypt holiday RTA case can be brought home

Judgment was today handed down by the Court of Appeal in Brownlie v FS Cairo (Brownlie No 2). After years of legal wrangle, it upheld that the case of this tragic road accident whilst on holiday in Egypt can be heard in the Courts of England and Wales. The Court of Appeal (Underhill V-P, McCombe LJ, Arnold LJ dissenting) has followed the majority decision of the Supreme Court in Brownlie No. 1 and held that the meaning of “damage” in the tort jurisdiction gateway means “any substantial” damage. In so finding, it has concluded that Lady Brownlie can bring her claim for damages sustained in a road accident in Egypt in 2010 before the Courts of England and Wales. The…

Peter Linstead successfully defends MyTaxi in Employment Tribunal

Peter Linstead recently appeared in the Employment Tribunal for the Respondent in Mr Christopher Johnson v MyTaxi Network Ltd 2303018. The background The Claimant in this action worked full-time as a Black Cab driver in London between 2014 and 2016. In February 2017, the Claimant downloaded the driver version of “Mytaxi”, a mobile application that connects Black Cab drivers and passengers. Excluding the “odd trip” in April, the Claimant didn’t actively use the app until the end of July 2017 and made no further trips after 18th April 2018. Double Success in GMC Appeal for James Counsell QC

In a judgment handed down by Warby J on 22 July, James Counsell QC was successful in an appeal and in a judicial review against the GMC in disciplinary proceedings brought against a cosmetic surgeon, Dr Ashish Dutta, arising out of allegations which went back to 2009. The judgment in R (on the application of Dr Ashish Dutta) v the General Medical Council [2020] EWHC 1974 (Admin) can be found here.
