Naomi Ling, as specialist pensions counsel, successfully defends DfT in High Court

As part of a team of counsel, Naomi Ling has successful defended Department for Transport against a challenge to their process of awarding rail franchises. Naomi Ling acted as specialist pensions counsel as part of an 11 strong counsel team defending the Department for Transport against a challenge to the 2019 rail franchising process. Arriva, Stagecoach and Virgin Trains (the latter acting as part of a consortium) were disqualified from the competitions from the East Midlands and South Eastern and West Coast Partnership rail franchises because they had failed to submit bids that were compliant with the pensions requirements. They challenged this decision, claiming that the Secretary of State had acted unlawfully in requiring them to assume uncertain future pensions…

John McKendrick QC acts for the Official Solicitor in the Administrative Court

John McKendrick QC was instructed to represent the Official Solicitor in her capacity as statutory office holder in the recent case of EG v Parole Board and Others. The Official Solicitor occasionally, but rarely, acts as office holder rather than litigation friend before the courts. Mrs Justice May was required to determine the consequences of the uncertainty of how an incapacitated prisoner could pursue his appeal before the Parole Board without an accredited representative or a litigation friend. The EHRC, Law Society, Lord Chancellor and the Official Solicitor were added to the proceedings. Emily Gordon Walker appointed fee-paid Employment Judge

Outer Temple is proud to announce that Emily Gordon Walker has been appointed as a fee paid Employment Judge, sitting at London Central Employment Tribunal. Her appointment brings the total number of appointed fee paid Employment Judges at Outer Temple to three, with her joining Keith Bryant QC and Andrew Allen QC in this position. Between January and April 2020, John McKendrick QC, Nicholas Johnson QC and Alex Haines were instructed on behalf of the Respondent in an international commercial dispute worth over £115 million. The dispute was between two parties in a former Soviet Republic, involving high value commodities. The arbitration took place under LCIA Rules and John and Alex represented the respondent at the hearing, which took place virtually. One witness was cross-examined from his overseas location and the legal representatives and Tribunal all participated remotely. Olinga Tahzib appears in virtual public hearing in Independent Inquiry into Child Sexual Abuse

Olinga Tahzib appears today in what is believed to be the UK’s first ever public inquiry to hear evidence in a virtual public hearing. The Hearing The hearing, which is part of the Independent Inquiry into Child Sexual Abuse’s investigation into Religious Organisations and Settings, runs from 11 – 22 May 2020. The original hearing which was due to take place in March was suspended after one day due to government advice regarding the Covid-19 pandemic. Since then, the Inquiry devised and tested a way of holding the hearing using video conference technology, ensuring the health and safety of all involved. Tom Gibson acted for the successful defendant in Purchase v Ahmed in striking out the claimant’s ‘secondary victim’ claim for psychiatric injury following the death of her daughter. In April, the Supreme Court handed down two important judgments concerning vicarious liability against Barclays Bank and WM Morrison Supermarkets. On 1 April 2020 the Supreme Court handed down two important judgments concerning vicarious liability: Barclays Bank plc v Various Claimants [2020] UKSC 13 and WM Morrison Supermarkets plc v Various Claimants [2020] UKSC 12. Whilst the impact of these cases will be felt across all claims relying upon vicarious liability, this article considers the potential effects on the particular area of sexual abuse claims. NCA v Baker & Others [2020] EWHC 822 (Admin) On 8 April 2020, the Queen’s Bench Division of the High Court of Justice handed down judgment in the matter of NCA v Baker & Ors [2020] EWHC 822 (Admin). The eagerly anticipated judgment of Lang J concerned an application to discharge three Unexplained Wealth Orders (‘UWOs’), and related Interim Freezing Orders (‘IFOs’), previously made by Supperstone J pursuant to sections 362A to 362R of the Proceeds of Crime Act 2002. The UWOs had been obtained by the National Crime Agency (‘NCA’) in relation to three London properties worth approximately £80 million.
