David Russell QC speaks at Global Tax Advisers Platform Conference

David Russell QC was recently invited to speak at the Global Tax Advisers Platform (GTAP) Global Conference in Torino on the topic of “Tax and the Future”. David Russell QC, as Deputy Chairman of the Society of Trust and Estate Practitioners (STEP) was invited to speak on the panel discussion and also signed the Torino-Busan Declaration. The declaration sets out four key short-term priorities to pursue its fundamental purpose: the promotion of public interest by ensuring the fair and efficient operation of national and international tax systems. Louis Weston and Sarah Crowther have co authored ‘How game theory can help us design more effective whistleblowing polices for sports’ for LawInSport. This two part article considers how sports bodies can design more effective whistleblowing polices. Part 1 (available here) examined three interesting scenarios from the behavioural field of game theory to help give us a better understanding of how decisions are made in difficult circumstances, analogous to those a potential Whistleblower may face. Alex Cisneros represents the Public Guardian in latest LPA guidance case before the Court of Protection

Alex Cisneros acted for the Office of the Public Guardian (“OPG”) in the latest guidance case before the Senior Judge of the Court of Protection, Her Honour Judge Hilder. This case involved fifteen applications where the donor of a Lasting Power of Attorney (“LPA”) had attempted to instruct their attorney to provide financial assistance and maintenance to a person other than themselves. The OPG asked for guidance from the court as to whether this was permitted or whether the instruction would fall foul of the gifting provisions within s.12 of the Mental Capacity Act 2005. Defence struck out following breach, Jonathan Hand QC successful in appeal

Jonathan Hand QC successfully represented Joan Kember in the High Court in Joan Kember (as Personal Representative of the Estate of Leonard Kember, Deceased, and on behalf of herself and all other dependants) v (1) Croydon Health Services NHS Trust (2) King’s College Hospital NHS Foundation Trust [2019] EWHC 2297. The case was an appeal against the decision not to grant an extension of time or relief from sanctions following late service of the Defendants’ Defence to a clinical negligence claim bought by Joan Kember. The clinical negligence claim arose following the death of her husband after a series of alleged failures in the care provided by the Defendants leading to a fatal delay in coronary artery bypass surgery. Claire van Overdijk successful in High Court testamentary capacity challenge

Claire van Overdijk successfully represented Ian Parsonage in Parsonage (acting as personal representative in the estate) v Parsonage & Ors [2019] EWHC 2362 (Ch), which involved a challenge to the validity of the last Will of Beryl Parsonage, a former matron, who died in 2015 at the age of 86. Mrs Parsonage had indicated in her last Will a wish to divide her estate equally between her children and revoked an earlier will drawn up in 2010.  Duncan Parsonage challenged the validity of the last Will on the grounds of testamentary capacity and lack of knowledge and approval, and argued that the earlier 2010 Will should be admitted to probate. No Laughing Matter – UK Border Force get it wrong

Oliver Powell, instructed by Peter Hastings of Rogers & Norton Solicitors, appeared in Court in Southampton in relation to a UK Border Force (‘UKBF’) investigation into a large scale importation of metal vial cream chargers containing 8 gram compressed nitrous oxide (laughing gas) cartridges (‘the Goods’)). Oliver Powell appeared on behalf of Rapid Infusion Limited (‘the Company’), a wholesaler that specialises in the sale of InfusoWhip, a rapid infusion set widely used in the catering industry. It was the UKBF’s case that the Goods imported were liable to forfeiture pursuant to s.49(1)(b) Customs and Excise Management Act 1979 (‘CEMA’) by virtue of the fact that the Goods were imported in breach of a prohibition imposed by s.12 PSA 2016.
