John McKendrick QC and Alex Haines strengthen OTC links to Latin America

John McKendrick QC and Alex Haines will be in Panama, Nicaragua, Mexico and Colombia between 28th August and 5th September 2019. At the Invitation of Nicaragua’s largest law firm, Consortium Legal, Alex and John will speak at a seminar at the Hotel Crowne Plaza in Managua on 30 August 2019.  The seminar will focus on the impact of international sanctions on Nicaragua and Venezuela and will cover (i) how sanctions work (with particular emphasis on US/OFAC sanctions); (ii) the Nicaragua Act 2018; (iii) how to challenge US and EU sanctions; and (iv) how to manage the risk of sanctions in business and private sector implementation.  The seminar will take place in Spanish and will be moderated by Rodrigo Taboada, partner…

IICSA publishes report on children in care of Nottinghamshire Councils

The Independent Inquiry into Child Sexual Abuse (IICSA) has published its report into the institutional responses to the sexual abuse of children in the care of Nottinghamshire County and Nottingham City Councils. The report can be found here. The Inquiry found that “The sexual abuse of children in the care of the Nottinghamshire Councils was widespread in both residential and foster care in the 1970s, 1980s and 1990s”. Counsel to the Nottingham investigation were all from Outer Temple Chambers: Patrick Sadd, Paul Livingston, Imogen Egan and Olinga Tahzib. The Inquiry received accounts of sexual abuse from around 350 people formerly in the care of the Councils, but noted that the true number of accounts was likely to be higher. The…

Chambers welcomes Alex Cisneros (year of call: 2015), who joined us from No 5 Chambers as a new member on 22 July. Alex is a specialist public law and private client barrister, and a member of the Court of Protection Bar Association committee. Alex Haines appointed to London B Panel

We are delighted to announce that Alex Haines has been appointed to the Attorney General’s London B Panel of Junior Counsel to the Crown. Alex’s appointment starts on 2 September 2019 and runs for five years. This brings OTC’s Attorney General Panel members to 11 following the appointment of Alex Line earlier this month. The UK Government relies on Panels for advice, guidance and representation. Alex specialises in (i) business crime and corruption including investigations; (ii) sanctions; (iii) regulatory and disciplinary proceedings; (iv) international organisations law; and (v) international arbitration involving international organisations. Alex is a rapporteur for Oxford International Organisations (an OUP publication), a member of the Bar Council International Committee and recently admitted to the New York Bar.

Tom Gibson acts for patient in successful sight loss claim

Tom Gibson acted for a successful claimant who lost the sight in his right eye after a hospital failed to organise proper follow-up care following retinal detachment surgery. The case was reported, before its successful conclusion, by the Daily Telegraph in April 2019 as part of a feature about systemic problems within the NHS [see here]. As that article explained, Mr Dalton was an active 71-year-old at the time of his retinal detachment surgery. He enjoyed extreme sports such as skydiving and climbing to Mount Everest Base Camp. However the loss of sight in his right eye – and with it his 3-dimensional vision – left him unable to go cycling and struggling to pour a cup of tea. James Aldridge and Robert Dickason in successful settlement of an unusual stillbirth claim

James Aldridge and Robert Dickason (instructed by Wolferstans) recently secured £120,000 in damages for the parents of a stillborn child. The child died as a result of inadequately managed pre-eclampsia late in pregnancy, leading to placental abruption. The settlement included compensation for the mother’s subsequent development of fibromyalgia as a result of the physical and psychiatric trauma which she went through, although the Defendant Trust did not admit causation. The judgment of the court is available on Lawtel [R v Basildon and Thurrock University Hospitals NHS Foundation Trust (2018)].

Olinga Tahzib appears in preliminary hearing in new investigation in Independent Inquiry into Child Sexual Abuse

Olinga Tahzib today appeared as junior counsel to the Inquiry at the first preliminary hearing in the latest investigation launched by the Independent Inquiry into Child Sexual Abuse: the investigation into child protection in religious organisations and settings. The new investigation, launched in May 2019, is thematic in nature and will review the current child protection policies, practices and procedures in religious institutions in England and Wales. Religions falling under its remit include non-conformist Christian denominations, the Jehovah’s Witnesses, Baptists, Methodists, Islam, Judaism, Sikhism, Hinduism and Buddhism. The new investigation, in which a two week public hearing is set to take place from 16 March 2020, is separate from the investigations into the Anglican and Roman Catholic Churches. We are delighted to announce that Alexander Line has been appointed to the Attorney General’s C panel. Alex’s appointment starts on 2 September and runs for five years. Government relies on the panels for advice, guidance and representation which means that Alex, ranked by Chambers & Partners for his expertise, will be available to carry out work for the Crown across his main areas of practice of public law and employment law. OTC/FRU Extended Pupillage Scheme opens for 2019 selection round

The selection competition for the 2019 OTC/FRU Extended Pupillage is now open. The scheme comprises 6 months’ work at FRU followed by a formal 1st six months pupillage at Chambers, and then a practising 2nd six months pupillage doing OTC and FRU casework. This year’s competition will be to find the fourth pupil since the scheme started in 2013. Applicants are invited to register their intention to apply for the scheme, by email, to Outer Temple’s Pupillage Coordinator (pupillage@outertemple.com) no later than 31 July 2019. Setting the discount rate (personal injury awards) – some thoughts

With the lord chancellor finally revealing a new personal injury discount rate after months of deliberations – and which is due to come into effect from 5 August – Sarah Crowther QC and Dan Clarke give their thoughts on the developments, setting them in context. Today’s headlines may focus on which ‘side’ of personal injury claims has ‘won’ or ‘lost’ but, as the authors indicate, the real winner may in fact be fairness. The review system appears to have increased transparency, consultation and evidenced-based decision-making, with a view to trying to ensure that compensation is truly both full and fair to both sides. Stephen Doherty successful in $14 million Dubai arbitration

Stephen recently acted for a high profile master developer in proceedings under the rules of the Dubai International Arbitration Centre (DIAC). The arbitration related to the sale and development of commercial real estate, and the provision of infrastructure by the master developer. Stephen acted as lead counsel over the course of a four day hearing, which heard evidence from a number of expert witnesses, and successfully obtained an award exceeding $14 million on behalf of his client. Stephen has recently returned to chambers following a secondment to the arbitration team of a leading UAE law firm. John McKendrick QC succcessfully acts in Court of Appeal termination case

John recently appeared for the appellant in the Court of Appeal challenging a first instance declaration that a termination at 23 weeks was lawful and in an incapacitated woman’s best interests. The appeal was heard urgently the day before the termination was due to take place. The Court of Appeal, McCombe, King and Peter Jackson LJJ granted permission to appeal, allowed the appeal and dismissed the NHS Trust’s application. The Judgment can be found here.
