Ian Johnston joins Outer Temple Chambers

Ian has recently retired as Chief Executive of the Dubai Financial Services Authority (DFSA) having joined the DFSA in November 2006 as a Managing Director heading the Policy and Legal Services Division. International Financial Institution successful before its Administrative Tribunal in Greece

Last month, Alex Haines and Alexandra Sidossis successfully represented and appeared on behalf of the Black Sea Trade and Development Bank (“BSTDB”), the Respondent in this case, before its Administrative Tribunal in Thessaloniki, Greece, where the BSTDB is headquartered. This was the first time in more than one decade that a case had been heard by the Administrative Tribunal. All grounds of appeal were dismissed and the Tribunal found that no internal laws of the BSTDB had been breached. Background International Administrative Tribunals (“IATs”) are judicial bodies established by international organisations. Tim Green instructed by TPR in precedent setting inquiry

The Pensions Regulator (“TPR”) has successfully concluded its first ever prosecution for general economic crime offences arising out of systematic abuse of the automatic enrolment scheme for workplace pensions. On 26 October at Derby Crown Court HHJ Shant QC, the Recorder of Derby, imposed fines and costs of £270, 000 on Workchain Limited, an employment agency which admitted unauthorised access to workers pension data to opt them out of their workplace pensions unlawfully. Seven directors and senior mangers were also sentenced to suspended prison sentences, community sentences and ordered to pay a total of £20,000 costs. Tim Green was briefed by TPR. Court of Appeal gives guidance on Unfair Terms Consumer Credit Regulations 1999

The Court of Appeal has handed down judgment in Jones & Anor v Roundlistic Ltd [2018] EWCA CIV 2284, an appeal from the Upper Tribunal (Land Chamber) which has ramifications for lessees and consumers generally, and the Air B’n’B industry in particular. David E. Grant and Elizabeth Grace represented the appellant lessees of a lower maisonette who contended that a term in a lease which prevented sub-letting to anyone not in the lessee’s family was unfair under the 1999 Regulations. The Upper Tribunal concluded that the clause was not unfair for three reasons despite creating a significant imbalance between the freeholder and leaseholder.
