Outer Temple Barristers authorised to sit in the Court of Protection

We are delighted to announce that Nathan Tavares QC, Mark Mullins and Simon Burrows have been authorised to sit as fee paid judges of the Court of Protection. They will deal with both health & welfare and property affairs cases. At the recent Court of Protection Practitioners Association annual conference in Manchester, Vice President of the Court, Mr Justice Hayden, said that the quality of applications for this recruitment exercise was the highest he had seen in any comparable competition. He welcomed the experience that new appointees to the Court would bring. Nathan, appointed QC this year, is a specialist clinical negligence and personal injury practitioner. The Ulaanbaatar Declaration David Russell QC is one of the authors of The Ulaanbaatar Declaration, which was signed by the Global Tax Advisers Platform (“GTAP”) on 12 September 2018. The Declaration sets out key priorities in international taxation, and promotes international cooperation among tax advisers, and optimisation of the national and international taxation framework. GTAP is an international platform that gathers national and international organisations of tax professionals from all around the world. Oliver Powell speaks at the Southampton Boat Show

Oliver Powell was invited by British Marine Insurance Financial and Legal Services to speak at the Southampton Boat Show. His seminar was a high level examination of the corporate offences of failure to prevent the criminal facilitation of tax evasion. In addition to a detailed analysis of the offences of failure to prevent facilitation of UK tax evasion (s.45 CFA 2017) and failure to prevent facilitation of foreign tax evasion (s.46 CFA 2017), the seminar developed a practical case study example and discussed the reasonable prevention procedures that a company should have in place in order to avoid the commission of an offence. Court of Appeal guidance on time limits for lodging appeals in the Employment Appeal Tribunal

Limitation period for lodging appeals: Two members of Outer Temple Chambers, Saul Margo and Will Young, acted recently for the successful Appellants in joined appeals in the Court of Appeal. These joined cases contain new guidance regarding extensions of time for lodging appeals to the Employment Appeal Tribunal. In both cases (Bonnie v DWP and Rana v LB Ealing), the Appellants had their claims dismissed in the ET and sought to appeal to the EAT. Similarly, in both instances the ET sent the judgment/reasons to the Appellants’ previous legal representatives, who had in fact come off the record and ceased acting for them. Court of Protection hands down two important judgments on deputyship orders

The London Borough of Enfield v Matrix Deputies Ltd & Anor [2018] EWCOP 22 (Matrix No2) sets down important guidance on the practice to be followed when an application is made to the Court of Protection to call in a deputy security bond where it is said that there has been a loss to the estate of an incapacitated person. It builds on previous guidance from the court in Re Gladys Meek and sets out what evidence the COP will expect to see and the process to be followed. Alex Haines workshop at the United Nations on International law

On Friday 14th September, Alex Haines gave a one-day workshop to the Staff Council of the United Nations Office in Vienna (“UNOV”). The workshop attendees included, inter alia, employees of the United Nations, the United Nations Office on Drugs and Crime (“UNODC”) and the International Atomic Energy Agency (“IAEA”). The workshop covered international administrative law and the United Nations’ internal justice system including its two-tier judicial system consisting of the Dispute Tribunal (“UNDT”) and Appeals Tribunal (“UNAT”). It also included a discussion on the new UN compensation package and the Global Service Delivery Model for the UN Secretariat. Tim Green in forge death inquiry

At Sheffield Crown Court on Friday 14 August, Tim Green appeared for the HSE in the prosecution of Abbey Forge Limited. The health and safety failings led to a £500,000 fine. The case arose from the death of a worker when manipulating very hard steel alloys under a 50 CWT hammer. BBC coverage of the case is available to read here.

John McKendrick QC instructed in serious medical treatment case

John McKendrick QC, instructed by Hannah Taylor of Bevan Brittan, appeared for an NHS Trust in a complex medical treatment case before Mr Justice Keehan. Judgment was handed down on 30 August 2018 after several days of oral evidence and submissions. The parties accepted aspects of the patient’s proposed care plan should be made, however, the judge ruled that CPR continued to be in the patient’s best interests, despite her frail condition. The case has been the subject of a number of media reports such as Daily Mail or ITV.

John McKendrick QC and Alex Haines speak in Mexico City

John and Alex have been invited by the Bar Council to speak at the first English Law Week in Mexico, a joint initiative between the Law Society and Bar Council. On 3 September, John will speak on the regulation of Fintech and his experiences as the Attorney General of Anguilla responsible for the Anguilla Utility Token Act, the first legislation to regulate utility tokens. On 4 September, John will chair two sessions on combating corruption and Alex will speak at the same sessions on corruption in the context of his experience of sanctions and Multilateral Development Banks. Oliver Powell acts for senior underwriters in proceedings brought by Council of Lloyd’s

In proceedings brought before the Lloyd’s Enforcement Board, two senior underwriters at a Lloyd’s Managing Agent have each accepted charges of discreditable conduct relating to improper appropriation by them of confidential information of commercial value to their employer. Background Mr Christopher Larkby and Mr David Larkby both worked as senior underwriters in the High Risk team at ERS Syndicate Management Limited (‘ERS’), underwriting on behalf of syndicate 218 until 2017, when they joined another insurance firm (not regulated by Lloyd’s). As persons who worked for a Lloyd’s managing agent, both individuals were and remain within Lloyd’s enforcement jurisdiction in respect of the acts committed during the relevant period.
