STEP Worldwide appoints Deputy Chair

We are delighted to announce that STEP has recently elected Outer Temple’s David Russell QC as Deputy Chair of STEP Worldwide. David’s term will start on 1 January 2018 and run for one year. STEP is the worldwide professional association for those lawyers, accountants and specialists advising families across generations. STEP promotes best practice, professional integrity and education to all members whose role is to help families plan for their futures. Peter Linstead addresses Dubai Employment Lawyers group

Peter Linstead has recently addressed the Dubai Employment Lawyers group, at the offices of Stephenson Harwood in Dubai. His presentation considered the implications of the anticipated new draft Employment Law on claims for discrimination in the DIFC Courts and considered to what extent it was helpful to apply English discrimination law concepts in the DIFC jurisdiction. High Court upholds appeal from PPF Ombudsman

David E. Grant and Olinga Tahzib appeared for the successful appellant in a High Court appeal from a determination of the Pension Protection Fund Ombudsman. The appeal concerned a narrow but important point of law regarding the construction of Paragraph 26 of Schedule 7 to the Pensions Act 2004 (“PA04”) and, in particular, “attributable to his pensionable service”. The facts The appellant, Mr Anthony Beaton, was an employee of CT Bowring & Co in the early 1970s and became a member of the Bowring Pension Scheme. Successful defeat of £2m misrepresentation claim

Andrew Maguire obtained an indemnity costs order for his clients in the High Court after successfully defeating £2million misrepresentation claim plus a 90% interim costs on account award. The buyer of a business had failed to prove that the seller had fraudulently and negligently misrepresented the level of an inter-company margin which impacted on the company’s viability, where the actual margin rate was readily ascertainable from the accounts. Consultation on new DIFC Trust Law and Foundation Law

The Dubai International Financial Centre (DIFC) has proposed a new Trust Law regime and a new Foundation Law regime and invited public comment on the new proposals. The deadline for providing comments ends on 8th November 2017. The proposed new laws are designed to make it easier for private wealth management and succession planning structures operating on both a conventional and Shari’a compliant basis. The proposed new laws arise from recommendations made by the DIFC’s Wealth Management Working Group. BAC Arbitrators Panel – Robert Rhodes selected
