Gerard McDermott KC secures £23 million in spinal cord road traffic collision case

Personal Injury expert, Gerard McDermott KC, along with Toby Coupe of Kings Chambers, secured £23m compensation on behalf of their client XY after a life-changing road traffic collision. Gerard, of Outer Temple Chambers, and Toby, of Kings Chambers, were instructed by Dan Herman, Charlotte Foster and Varsha Chandrasegaran of Stewarts Law in a road-collision case where XY, a young woman in her early twenties, sustained a life-changing spinal cord injury when her car was hit by a stolen vehicle. The stolen, speeding car had collided into the offside of XY’s car causing her to crash and, as a result, XY sustained a spinal cord injury. Josh Hitchens appears in third ever de-listing claim against the FCDO under the UK’s post-Brexit sanctions framework and the second to be brought under the Russia Regulations. On 15 and 16 November 2023, the High Court heard the second claim brought against the FCDO under s.38 Sanctions and Anti-Money Laundering Act 2018 in respect of the Russia Regulations. Josh Hitchens appeared as sole counsel for the Claimant. The case before Swift J concerned the lawfulness of interferences with the right to freedom of expression through sanctions designations and the proper approach to rational connection and proportionality when considering whether interferences with Convention Rights are lawful in a sanctions context. Tom Gibson acts for successful claimant in unusual bowel surgery case

Tom Gibson acted for the successful claimant in an unusual bowel surgery case – where the largest claim was for increased food costs for life.  The claimant was aged 13, in Year 8 at secondary school, when his local hospital failed to diagnose a volvulus, or twisted small bowel. The delay in diagnosis and in operating led to the tissue death and loss of most of his small bowel. He was left with 30cm of small bowel, compared to the average of around 600cm. With competent treatment, and timely surgery, his bowel loss would have been avoided completely. Outer Temple’s John McKendrick KC and Josh Hitchens have been instructed in a judicial review of the Lord Chancellor’s refusal to hold a public inquiry into abuse at Medomsley Detention Centre (“MDC”). A new investigation has been launched into the abuse at Medomsley Detention Centre after thousands of inmates have reported being attacked at the County Durham facility between 1961 and 1987. John McKendrick KC and Josh Hitchens, instructed by David Greenwood of Switalskis solicitors, were instructed in a judicial review of the Lord Chancellor’s refusal to hold a public inquiry into abuse at Medomsley Detention Centre (“MDC”).
