Corruption in football – Matthew McDonagh comments

The allegations made this morning against Tommy Wright, the Barnsley assistant manager, are the latest in what is likely to be a continuous media release of corrupt activities in football. David Pope obtains summary judgment in interest-rate swap case

David Pope represented Barclays Bank Plc in its successful application for summary judgment in Marsden v Barclays Bank Plc [2016] EWHC 1601 (QB), an interest-rate swap mis-selling case. The Claimant alleged that Barclays had mis-sold two interest-rate swaps totalling £2.25 million and had failed properly to review the sales within the review process established by agreement between Barclays and the Financial Conduct Authority. Barclays denied the claim and applied for summary judgment primarily on the basis that any arguable cause of action against it had been compromised by a settlement agreement. Mr. Justice Phillips gave summary judgment in favour of Barclays and dismissed the claim. He held that the settlement agreement did cover all the Claimant’s arguable causes of action.…

High-profile case discussed in APIL’s PI Focus

Mark Pollock, a blind adventure athlete and well-known motivational speaker, is now paraplegic after falling through a second floor window of a residential property. Instructed with Christopher Wilson-Smith QC by Ben Rogers, Partner at Stewarts Law, Matthew Stockwell acted for Mark Pollock in his successful claim against the householders’ insurer. The trial attracted widespread media attention in the UK and Ireland. The case raised a number interesting issues, in particular the duties owed to disabled visitors by an occupier, which are discussed in an article co-written by Matthew and Ben Rogers. Gender approach in the legal profession

Kate Davenport QC speaks about the current gender approach in the legal profession in her recent LawTalk article. Throughout her comprehensive analysis, Kate refers to the July 2016 United Kingdom Bar Standards Board’s report on Women at the Bar and to the Summary of Josh Pemberton’s report on Experiences in Retention of New Zealand Junior Lawyers. Both reports reveal the fact that, in New Zealand and the United Kingdom, being a woman has negative effects both on developing a legal career and on the retention prospects of young professionals within the legal world. G4S fined £1.8m for Legionnaires Disease exposure risk

Fiona Horlick acted for Harlow District Council in their prosecution of G4S Cash Solutions Ltd for serious breaches of the Health and Safety at Work Act 1974. G4S were sentenced on 2nd September 2016 at Chelmsford Crown Court. The Judge found a ‘flagrant breach of the law’ following G4S’s persistent failure over a number of years to protect its staff and visitors from the risk of exposure to legionella bacteria which carries a risk of death from Legionnaires Disease. G4S, a company with a turnover of £250 million, were fined a total of £1.8m and ordered to pay all the prosecution costs. The Judge, in applying the new sentencing guidelines, found very high culpability coupled with a statistically low risk…

Direct rights against insurers: what Europe ever did for us

Sarah Crowther has recently authored an article in the Journal of Personal Injury Law, in which she examines EU law provisions that have obliged the UK to provide the victims of road traffic accidents (RTAs) with a direct right of action against the insurer of the vehicle involved, including in RTAs with a cross-border element. She proceeds to review case law addressing the jurisdiction issues that may be raised in direct rights cases and considers how the UK’s withdrawal from the EU might affect the direct rights regime. Oliver Powell appears before Privy Council

Oliver Powell, led by the Attorney General of Anguilla, appeared before the Judicial Committee of the Privy Council in the matter of the Superintendent of Prisons & Another v Hamilton [2016] UKPC 23. The Respondent, Neville Hamilton, was dismissed as the Deputy Superintendent of Prisons by the Governor of Anguilla, to whom charges that the Respondent had been in neglect of duty under s.2(d) of the Code of Discipline had been referred by the First Respondent. The power to refer charges to the Governor under s.7(2) of the Code was successfully challenged by the Respondent in judicial review proceedings before High Court of Justice of the Eastern Caribbean Supreme Court, Anguilla Circuit.
