David Pope joins Outer Temple Chambers

We are delighted to announce that David Pope has recently joined Outer Temple Chambers. David specialises in arbitration and commercial litigation, having considerable experience of arbitral proceedings under the ICC and LCIA rules. He is also a qualified mediator and is a welcome addition to our team. David acts among others, for and against banks, in disputes covering many aspects of retail and investment banking and in a large number of claims involving the alleged mis-selling of swaps and other interest-rate hedging products. Internationally, David acts in financial-services and in energy and telecommunications industries cases. He is also a Senior Visiting Fellow at University College London, teaching “Classical rhetoric and modern advocacy”.

Michael Bowes QC reviews current progress in anti-corruption enforcement

Michael Bowes QC, a trustee of Transparency International UK, contributes to a new publication, Anti-Corruption Regulation 2016. His contribution is entitled “Current progress in anti-corruption enforcement”. He analyses global anti-corruption actions and starts with the example of several major corruption cases. One of them is the FIFA case in relation to which Michael shows the way the US approached it, especially through the Foreign Corrupt Practices Act, a law which is being continuously enforced. Michael advises that “Major developments in the FIFA corruption investigation may be expected this year”. In Europe, some positive action has been taken in the UK in relation to the Bribery Act 2010. Oliver Powell speaks at HMRC’s FPU Conference 2016

Oliver Powell was invited to speak at HMRC’s biannual FPU Conference. His talk was concerned with restraint and confiscation pursuant to the Proceeds of Crime Act 2002. Other speakers included inter alia Dave Standish & Nigel Spare of KPMG and Peter Maxwell & Sally Dallow of Bond Dickinson. The talk was attended by over 40 HMRC employees, including; lawyers, accountants and financial investigators. Outer Temple continues to lead the way in asset recovery and financial crime, both domestically and internationally.

David Russell QC & Katarina Sydow in Vatican anti-slavery forum

David Russell QC and Katarina Sydow were invited to participate in the Global Sustainability Network Forum at the Vatican on 18 March 2016. There were presentations from leaders in business, law, the media and government, alongside discussions on how best to raise awareness of and tackle human trafficking and modern day slavery. David and Katarina previously participated in a Strategic Planning Session on this issue at Lambeth Palace, hosted by the Archbishop of Canterbury and the Bishop of Derby.

Robert Rhodes QC speaks on Tax Evasion

Robert Rhodes QC was the first speaker at the joint Revenue Bar Association / Criminal Bar Association seminar on tax evasion, held earlier this week. Robert spoke about the Revenue’s approach to tax evasion, and how it had become much more prosecution-oriented than in the 10 years when he had been Standing Counsel to the Inland Revenue before taking silk. He discussed the civil and criminal paths that the Revenue took, and their consequences. He also dealt with the Revenue disclosure facilities for errant taxpayers, including the Liechtenstein Disclosure Facility which, over its 6 years of existence, raised billions of pounds for the Revenue. Pension case repercussions reviewed by Richard Hitchcock QC & Jennifer Seaman

The starting point of the authors’ review is Mrs Justice Asplin’s decision in Merchant Navy Ratings Pension Fund Trustees Ltd v Stena Line Ltd [2015] EWHC 448 (Ch), which contains useful guidance on how to approach a trustee’s fiduciary duty to act in the best interests of the beneficiaries. Harry Trusted, Eliot Woolf & Ben Bradley in Wheelchair Awareness Day

Three Outer Temple Barristers were invited to take part in a wheelchair awareness day, organised by Bolt Burdon Kemp Solicitors, with the able assistance of the Back-Up Trust and the Wheelchair Rugby Experience. Harry Trusted, Eliot Woolf and Ben Bradley spent the morning learning essential wheelchair skills with the Back-Up Trust. They were then sent off into the wilds of Islington in said chairs to (amongst other things) board a bus; buy a coffee; undertake a weekly shop; tackle cobbled streets and find a wheelchair accessible beauty salon. The afternoon was spent playing the brutal sport of wheelchair rugby, run by the inspirational athletes at the Wheelchair Rugby Experience. Robert Rhodes QC on Bribery & Corruption at COMBAR North American Meeting

Outer Temple Chambers barristers recently participated in the 2016 COMBAR North American Meeting, which was held in Venice, Italy, from Thursday 31 March to Friday 1 April 2016. Robert Rhodes QC was part of the “Bribery & Corruption” panel session attended by the Lord Chief Justice Lord Thomas where Robert spoke about “adequate procedures” under the Bribery Act 2010. John McKendrick QC in Guatemala

At the invitation of the United Nations, John addressed a major event in Guatemala City on 1 April 2016. He spoke alongside the Guatemalan minister for Government, Sr. Francisco Rivas, the British Charge d’Affaires, Mr Andrew Tate and various international experts. The purpose of the seminar was to strengthen Guatemalan efforts against illicit trade and to strengthen law enforcement organisations and the rule of law. John has worked across Latin America for many years and speaks Spanish.

Nathan Tavares successfully defends Hickstead in spinal injury claim

Nathan Tavares successfully defended Hickstead Ltd, hosts of the Royal International Horse Show, against the claim of Mr Lear, a participant injured when the ramp of his horsebox fell on him causing paraplegia. Mr Lear was a competitor at the Longines Royal International Horse Show, at the Hickstead Showground, Sussex, on 30th July 2011. He was permitted to park his 18 tonne horsebox in a field designated for horseboxes and left it’s rear ramp lowered. He returned to the vehicle about 4 hours later and found that the ramp had been raised and shut. He proceeded to open it and the ramp fell down on him with great force, resulting in fractures to his spine which have rendered him paraplegic.…

At the invitation of the British Embassies, John has been working in both Tegucigalpa, Honduras and San Salvador, El Salvador. John has delivered a series of high level presentations to public officials on the rule of law, anti-corruption and anti-contraband measures.
