Tim Green successful in high profile waste crime investigation

Tim Green appeared for the Environment Agency in a successful high profile investigation into waste crime committed by companies, their directors and managers heard at Hereford Crown Court over 4 days between 15 to 18 February 2016. Tim is recognised as one of the UK’s leaders in environmental law and is regularly instructed by companies, their officers, private prosecutors and regulators in respect of complex and sensitive environmental enforcement activity.

Tim Green’s cash forfeiture application in Crown Dependency

In December 2015, Tim Green was successful in his application to have a high value cash forfeiture heard in the Isle of Man before a related criminal investigation being undertaken in the UK and other jurisdictions had concluded. At the heart of the case was an argument over whether related civil proceedings (the cash forfeiture) could fairly be heard whilst a related criminal was continuing. In the absence of clear authority on the question, the Court of Summary Jurisdiction in the Isle of Man reviewed analogous English and Manx authorities. The Court then found in a full and published judgement that civil court had a discretion to proceed where there were concurrent civil and criminal proceedings. The Judgement concluded that…

Could changes in LIBOR-setting lead to frustration in current contracts?

Banking & Finance analysis: There is a move to transaction-based benchmarks for calculating LIBOR rates. Saaman Pourghadiri was interviewed by LexisPSL, on questions whether this change in methodology is likely to lead to frustration in current contracts. He specialises in commercial litigation and financial services. Dr Ali Almihdar awarded by Saudi-British Society 2016

Dr Ali Almihdar is one of the two winners of the 2016 Rawabi Holding Awards. The annual awards, for making a significant contribution to Saudi-British relations, have previously gone only to British citizens. This year, for the first time, Dr Almihdar, a Saudi citizen was given the award. The awards are made by Sheikh Abdulaziz al Turki, a leading Saudi businessman from the Eastern Province. The candidates are chosen from a wide range of fields in which they have made a contribution, including; education, literature, journalism, sport, women’s affairs, welfare and medicine. The award-giving ceremony, which is an important part of the Saudi-British Society’s programme, was held in conjunction with the Society’s Annual Dinner, on 10th February 2016. The prizes…

EU law junior Miranda de Savorgnani is interviewed by LexisPSL, on the impact of EU reform negotiations could have on competitiveness and regulation in the UK. Miranda has a strong background in EU law, having been an EU competition law associate at Stibbe law firm in Amsterdam for three years prior to coming to the Bar, where she represented multinationals in EU Commission cartel investigations, merger notifications and litigation before the EU General Court. Since becoming a tenant at OTC, she has worked with Stewarts Law LLP on a competition follow-on damages claim by a consortium of UK retailers against Mastercard and Visa for inflated interchange fees. A Corporate Crime analysis has been made on the basis of a case involving the Director of the Serious Fraud Office. It outlines the extent to which legal privilege can be invoked when withholding documents from public bodies. Eleanor examines the decision of the Divisional Court and appreciates that it is ‘helpful from an advisory perspective for corporate crime lawyers, in that it gives considerable insight into the process that is followed by the SFO in dealing with material which may fall within the protections of LPP’.

Northern Ireland’s equality legislation vs European human rights laws

In 2015, Ashers bakery was found to have discriminated against a customer on the grounds of sexual orientation and political opinion. The complicated so-called ‘gay cake’ case seemed to be nearing its conclusion, when the last-minute postponement of the hearing extended the appeal issues. The Attorney General then intervened into the case claiming there was a potential conflict between Northern Ireland’s equality legislation and European human rights laws and that the case raised constitutional issues arising from the devolution arrangements in Northern Ireland. Further to this intervention, a special hearing will now take place on Wednesday, 3rd March 2016, and the appeal itself is re-listed to start on 9th May 2016.

Barrister and solicitors cleared of negligence over court settlement

Cara Guthrie successfully defends a barrister who advised a claimant to settle her road traffic claim on a full and final basis on the morning of a liability trial. He was found not to be negligent even though it has since become clear that the claimant’s injuries were very much more severe than was apparent at the time. The claimant brought a professional negligence claim against her former solicitors and barrister alleging that she had been advised to settle her personal injury claim at an undervalue at the court door. Elisabeth Laing J heard the issues on breach of duty and dismissed the claim against both defendants. Laing J was not persuaded that the barrister defendant “had assessed the evidence…

The Upper Tribunal refuses to split trial in Keydata references

The Upper Tribunal today published a decision giving reasons for refusing the Authority’s application for a “split trial” of the conjoined references of Stewart Ford (the former CEO), Mark Owen (the former FD) and Peter Johnson (the former compliance officer) arising out of the failure of Keydata Investment Services Limited (“Keydata”). Keydata was involved with certain investment products underpinned by bonds issued by two special purpose vehicles incorporated in Luxembourg, SLS Capital SA and Lifemark SA (“Lifemark”). The Luxembourg regulator (the CSSF) closed Lifemark to new business in mid-2009, and it was put into liquidation on 11 May 2012. Keydata ceased trading in June 2009 and went into administration. James Leonard in landmark corporate manslaughter case

James Leonard, led by Ian Stern QC (2 Bedford Row), represented Dr Errol Cornish in a landmark corporate manslaughter case, against an anaesthetist and NHS trust. The trial collapsed in the third week of the hearing at Inner London Crown Court. The Jury were instructed by Mr Justice Coulson, to acquit both defendants on Thursday, having ruled the day before that they had no case to answer. It was the first time a health service body had been prosecuted, following the introduction of the offence. There will be no appeal. James Leonard was instructed by Richard Privett and Sam Flew of Radcliffes Le Brasseur.
