Christopher Wilson-Smith QC and Matthew Stockwell secure damages for blind adventure athlete paralysed by a fall

Instructed by leading litigation firm Stewarts Law LLP, Christopher and Matthew advised and represented Mark Pollock throughout his claim, obtaining judgment following a “difficult” five-day trial before William Davis J. Unbroken by blindness at 22, Mark competed in ultra endurance races across deserts, mountains, and the polar ice caps including an epic two month expedition race to the South Pole. He won silver and bronze rowing in the Commonwealth Games. Describing Mark, the Judge said: “His athletic achievements would have been notable for someone without disability. Given his blindness they were and are remarkable”. The judgment provides much needed security whilst Mark continues his journey, now as a pioneer exploring the frontiers of spinal cord injury recovery.

Moreno v Motor Insurers’ Bureau

Miss Moreno was a young mother on holiday with her toddler son and partner in Zakynthos, Greece. Whilst walking alongside a road on 17 May 2011, she was struck and grievously injured by a car whose driver was uninsured. Her injuries resulted in amputation of her leg and significant damage to the other leg. She brought a claim before the courts of England and Wales against the Motor Insurers’ Bureau pursuant to the Motor Vehicles (Compulsory Insurance)(Information Centre and Compensation Body) Regulations 2003 (SI 2003/37). Liability to compensate Miss Moreno is admitted by MIB, but it asserts that the previous Court of Appeal decisions in Jacobs v MIB [2010] EWCA Civ 1208; [2011] 1 WLR 2609 and Bloy and Ireson…

Michael Bowes QC and Eleanor Davison in panel discussion with SFO and DoJ on corporate internal investigations

Michael Bowes QC chaired a discussion between senior prosectors and defence practitioners to discuss the controversial topic of corporate internal investigations. Eleanor Davison was a member of the panel, which included the Director of the SFO, David Green QC, Harry Chernoff, an assistant US attorney at the DoJ and Judith Seddon, a partner at Clifford Chance. This was a “closed” seminar organised and recorded by Global Investigation Review. Fiona Horlick appeared for the Institute and Faculty of Actuaries in a disciplinary case

Fiona Horlick appeared for the Institute and Faculty of Actuaries (IFoA) in a recent disciplinary hearing involving allegations brought by IFoA against two scheme actuaries. The facts involved their misconduct in relation to three pension schemes including breaches of the pensions legislation in relation to scheme actuary work, breaches of the TASs and incompetence in relation to their work. Both were expelled from membership.

James Counsell and Ben Bradley succeed in landmark sex abuse case against the Jehovah’s Witnesses Organisation

In a landmark ruling, Mr Justice Globe has today imposed vicarious liability upon the Jehovah’s Witnesses (JWs) organisation both for: the acts of sexual abuse committed by one of its ministerial servants, Peter Stewart (PS), upon the Claimant (“the abuse claim”); and; the failures, on the part of its Elders, to safeguard the Claimant from acts of further sexual abuse, in circumstances where they knew PS was a paedophile, but viewed him as being repentant for his sins, thereby permitting him to remain in the congregation (“the safeguarding claim”). James Counsell and Ben Bradley (instructed by Kathleen Hallisey of AO Advocates) acted for the Claimant, in what is the first case of this nature to be brought against the JWs.…

Outer Temple sings at ABA opening ceremony

A Legal Harmony choir of 70 singers from a range of legal firms and chambers performed at the opening ceremony of the American Bar Association London Session in front of 800 American Lawyers. The ceremony was held at Central Hall Westminster yesterday, commemorating 800 years of Magna Carta. Speakers included: Alistair MacDonald QC, Chairman of the Bar of England and Wales, Andrew Caplen, President of the Law Society and Lord Neuberger who provided the keynote speech. The choir was made up from the following firms: Allen & Overy, Berwin Leighton Paisner, Devonshires, Freshfields, Fieldfisher, Hogan Lovells, Howard Kennedy, Outer Temple Chambers and Wragge Lawrence Graham. Three singers from Outer Temple joined the choir which was pulled together by Legal Harmony…

Andrew Spink QC and James Rickards successful in Contribution Notice case

Andrew Spink QC and James Rickards (instructed on behalf of the Trustee by Victoria Leigh of Squire Patton Boggs) have appeared before the Determinations Panel in relation to the Carrington Wire Defined Benefit Scheme (the “Scheme”). The case concerned the termination of a guarantee given by OAO Severstal (a large steel company based in Russia whose subsidiary Severstal-Meitz was also a target) that guaranteed Carrington Wire’s funding obligations to the Scheme (Carrington Wire being the Scheme’s principal employer). The termination of the guarantee was contrary to various assurances given by OAO Severstal and Severstal-Meitz that the guarantee would remain in place. The case against OAO Severstal (and its immediate subsidiary Severstal-Meitz) settled shortly before the commencement of the Determination Panel’s hearing…

Paul Rogers teaching advocacy in The Hague

Paul Rogers has been invited by the Advocacy Training Council (ATC), the BSB approved training entity for the Bar, to conduct advocacy training  in The Hague. The training will take place over two days, 23/24 May, and is part of the international advocacy course for lawyers practising at the international tribunals in The Hague.
