David Westcott QC and Rachel Vickers recently received judgment in favour of their Claimant client after a five day Clinical Negligence Liability trial. The Claimant was born by emergency Caesarean section and suffered Hypoxic Ischaemic at birth leading to Cerebral Palsy. Timings in the build up to the birth and cross referencing the Claimant’s medical records were crucial in determining the outcome. Click here for an extended summary of the complex issues involved. The Employment Tribunal has held that lay members of the Criminal Injuries Compensation Tribunal who are ticketed to chair hearings in the First-tier Tribunal carry out work that is “broadly similar” to the work of judges in the First-tier Tribunal Tax Chamber. This case is part of the long-running part-time judges litigation and it is the first time that a “judge” who is not legally qualified has been found to have a judicial comparator for the purposes of the Part-time Workers Regulations. The result means that the claimants and other current office holders will receive a pension and other financial benefits associated with full-time employment in their jurisdiction. Outer Temple Business Team members Andrew Spink QC, David Russell QC, Michael Bowes QC and Miranda De Savorgnani were joined on a panel at the St Petersburg Legal Forum by India’s Minister for Law and Justice, D. V. Sadananda Gowda. The panel examined the advantages of using specialist barristers in commercial litigation and arbitration and third party funding in such cases. Outer Temple has participated in several satellite legal events hosted by Russia’s RBC network, a large business media group. The events were centred around Case studies and practical aspects of Arbitration and Litigation, and were designed to showcase the ability and expertise of the UK Bar in leading bespoke international legal projects. Tim Green has appeared for the HSE in a complex investigation into unsafe excavations in Holbeach, Lincolnshire. Following a three week trial, including expert evidence and multiple rulings on the law before HHJ Pini QC, John Henry and Sons (Civil Engineers) Ltd were convicted by a unanimous verdict of breach of section 3 (1) HSWA. John Henry and Sons will be sentenced with their corporate co-defendants on 10 October. Since his appointment to the Attorney General’s A Panel of approved regulatory advocates in 2013, Tim has appeared in over 20 cases arising from death or serious injury at work. She practises in London and from Chambers’ New York office as both an English Barrister and a New York attorney. In recognition of their pro bono work for Barnardo’s, John McKendrick QC and Katarina Sydow were invited to a reception at Buckingham Palace on 12 May 2016, celebrating the 150th anniversary of the charity’s foundation. John and Katarina have provided advice and training to Barnardo’s and were delighted to participate in the event, which recognised the work of Barnardo’s staff and volunteers in improving the lives of vulnerable children. Just for Kids Law has launched the ‘Advocacy First’ Scheme through which three graduate recruits will be selected to work as part of the charity’s outreach team after completing a one month training programme. Michael Bowes QC advises that “Advocacy First is a brilliant opportunity for graduates who are considering becoming lawyers, to learn practical advocacy skills by helping young people in need. Being selected to be on Advocacy First would be a definite plus point on anyone’s CV”.
