Chaitanya Kediyal of Outer Temple Chambers supported the team in this case and will join the panel with his observations. The event will be chaired by David Russell KC of Outer Temple Chambers.
In the much anticipated judgment, GATE MENA DMCC & HUOBI MENA FZC V TABARAK INVESTMENT CAPITAL LTD & ANR, the DIFC Court of Appeal (Justice Black KC giving the leading judgment) reviewed the law in relation to digital assets, and made observations in relation to DIFC law which have implications beyond digital assets. A re-trial against Tabarak has been ordered.
This issue has been brought into sharp focus with the DIFC Authority’s recent consultation – ‘Proposed Amendments to the Law on the Application of Civil and Commercial Laws in the DIFC’. Issues considered at this talk will be wide-ranging, and will include fundamental questions such as whether consideration is required under the DIFC Contract Law.
The expert panel will discuss the key points from the judgment, alongside where the DIFC is and where it is going in terms of its status as a common law jurisdiction.

David Russell KC commenced legal practice in 1974. He currently practises in Dubai, London, and Abu Dhabi (Outer Temple Chambers), Sydney (Ground Floor Wentworth Chambers) and Brisbane (Sir Harry Gibbs Chambers). He has acted for Commonwealth and State Governments as well as individuals and corporations. Andrew Spink KC is a highly respected advocate with 38 years’ experience at the Bar and over 20 years as a successful silk (QC/KC). Andrew has an extensive business law practice, specialising particularly in disputes or advisory work relating to the interpretation or breach of most types of commercial contract and trust deed, claims for breach of fiduciary duty, freezing injunctions & asset recovery, cross-jurisdictional issues, claims for damages & other relief in the context of pensions & other commercial trusts, banking & financial services, fintech & a wide range of other commercial contracts, professional negligence claims and company law and insolvency issues.
Justina Stewart’s practice encompasses the full range of commercial litigation, with a particular emphasis on banking and financial services, civil fraud, fintech and digital assets, insolvency and international arbitration. Justina is ranked as a Leading Junior in Chambers UK Bar, Chambers Global, Legal 500 and Legal 500 Middle East. Justina’s cases frequently involve multi-jurisdictional elements and matters which are notable for their complexity and novelty.
Chaitanya practises across Chambers’ core areas. He has experience in commercial litigation, civil fraud, company and insolvency disputes, employment, sports, digital assets, sanctions, pensions, and trusts litigation. Chaitanya also has experience of disputes with an international element, particularly those with an emphasis on the Middle East.
Peter is a barrister at Charles Russell Speechlys with experience of a wide range of civil and commercial disputes and sectors, including arbitration, banking and finance, company, employment, insurance, insolvency, media, real estate, technology and construction, and professional negligence. Peter was a key part of the legal team instructed in this case.
