James Counsell KC, Outer Temple Chambers
In the field of Financial Services, James acts for defendants in contempt proceedings in the Business and Property Courts, brought against individuals for alleged breaches of freezing and disclosure orders and for claimants and financial institutions in mis-selling claims and other regulatory breaches. He represents litigants in the UK and also in the Middle East with ongoing clients in the DIFC Courts in Dubai. He has acted in multi-million-pound disputes and ground-breaking decisions. He has acted for Lloyd’s of London in proceedings against Lloyd’s brokers and underwriters in the Disciplinary and Appeal Tribunal.
Oliver Powell KC, Outer Temple Chambers
Oliver is ranked in the Legal 500 for Financial Services Regulation. His Financial Services practice focuses on banking disputes and financial crime. This predominantly includes: regulatory enforcement action taken by the FCA and Lloyd’s; internal investigations conducted by banks and financial institutions; and prosecutions brought by the FCA and SFO. Many of his cases have an international element, and usually involve allegations of dishonesty or breach of trust. As well as conducting contentious work, which sees him appear in the Commercial Court, Crown Court and regulatory tribunals, Oliver maintains a busy advisory practice, providing opinions on FCA and PRA regulatory issues; AML and economic sanctions.
Michael Uberoi, Outer Temple Chambers
Michael’s practice often covers the regulatory and civil aspects of financial services law, in which areas Michael is particularly well placed to advise having previously undertaken a secondment to the Financial Conduct Authority. Of his Financial Services work, the directories state that “Michael is very willing to get stuck into the matter right away and offers a pragmatic, commercial steer backed up by careful analysis of his lay client’s circumstances” (Legal 500, Financial Services Regulation, 2023) and that he is: “personable, technically outstanding, and very hard working and responsive” (Legal 500, FS Regulation).
Clare Baker, Outer Temple Chambers
Clare is highly experienced in financial services regulatory law, possessing a comprehensive grasp of both UK and EU financial regulations. Her experience includes secondments to the FCA during which she contributed to the development of FCA rules, specifically related to consumer credit and claims management. She has also played a role in post-Brexit regulatory reform, including in relation to the Designated Activities Regime. Her expertise encompasses various facets of UK and European financial services regulation, including IBOR transition, benchmarks, ESG and advice in relation to crypto assets and AI. Clare has co-authored Butterworths Financial Regulations Service and is a member of the Chancery Bar Association, Commercial Law Bar Association and the Financial Services Lawyers Association.
Justina Stewart, Outer Temple Chambers
Justina is ranked as a Leading Junior in banking and finance and financial services regulation. Her background as an international investment banker and economist means that she can understand the more technical and mathematical aspects of financial products – a skill that is often invaluable in banking and financial services cases. She has been involved in a range of high-profile and innovative banking and financial services cases.
Jeremy Scott-Joynt, Outer Temple Chambers
Having spent more than a decade in banking and regulation, Jeremy has particular expertise in dealing with financial services matters. He has provided advice to, and been seconded to, the Financial Conduct Authority, working both with its General Counsel’s Division and with Supervision and Enforcement; and the Payment Systems Regulator. He also spent a year supporting the Independent Third Party addressing complaints from small business customers of RBS’s Global Restructuring Group. His regulatory experience includes work on the developing area of investments in, and regulation of, medicinal cannabis firms. He has advised and acted for clients in several crypto-related matters.
Henry Reid , Outer Temple Chambers
Henry focuses on advising entities and individuals on a range of non-contentious and regulatory financial services matters. Since moving to the Bar in 2022, Henry has been ranked by Legal 500 as a Rising Star in Financial Services Regulation. His experience has centered on market regulatory frameworks. Through this, he has developed a strong practical understanding of securities, derivatives and various spot markets including FX. It has also centred on giving advice to firms and individuals seeking FCA authorisation and/or approval. This experience has led to a strong appreciation of FCA Rules, associated guidance and the scope and operation of regulatory perimeter created under FSMA, 2000.
Imogen Makin, Wilmer Hale
Imogen Makin is a senior contentious regulatory lawyer, who has worked on some of the most high-profile regulatory investigations in the post-financial crisis period. She regularly acts for a wide range of financial institutions on both domestic and international investigations involving multiple regulators and government agencies. She has extensive experience of Financial Conduct Authority (FCA) enforcement investigations, including acting on a dual-track anti-money laundering investigation into anti-financial crime systems and controls, and successfully defended a financial institution in relation to global bribery investigations, as well as representing C-suite directors in FCA enforcement proceedings.
Rachel Couter, Osborne Clarke
Rachel is Partner in the Commercial and Regulatory Disputes team at Osborne Clarke. She is head of their UK contentious financial services practice, specialising in regulatory investigations and banking and financial markets litigation. Rachel is named as a leading individual by both Legal 500 and Chambers and is also in Legal 500’s “Hall of Fame”. She has acted for and advised various financial institutions and corporate entities, including banks, brokers, asset managers, alternative lenders, custodians, trading platforms, SIPP operators, fintech companies and payment services providers, as well as individuals within those organisations, in a wide range of complex matters, including multi-jurisdictional regulatory and fraud investigations, disputes and enforcement proceedings.
Katie Fry-Paul, Coinbase
Katie is Senior Legal Counsel at Coinbase. She has particular experience in advising clients on the financial services regulatory issues which arise when dealing with cryptoassets, and how best to handle potential challenges from the regulator. Her clients include cryptoasset exchanges, DeFi protocol developers, token issuers, payment service providers and wallet providers. Katie is known for her valuable insights on new regulatory developments, industry best practices and emerging trends and has had articles featured in publications including Crypto AM.
