Jennifer Seaman and Victoria Brown update Tolley’s Pension Law Chapter on Dispute Resolution and Pension Scheme Litigation. 

Jennifer Seaman and Victoria Brown have updated and published the Tolley’s Pension Law Chapter on Dispute Resolution and Pension Scheme Litigation. Tolley’s Pension Law is a leading ‘loose-leaf’ pensions text book – published by Lexis Nexis.

The chapter on dispute resolution and pension scheme litigation focuses on occupational pension schemes and gives the latest updates on procedures available to resolve disputes in such schemes, including:

  • litigation before the courts (covering the latest case law in this area, e.g. the British Airways Pension Scheme litigation and FSHC Group Holdings Ltd and subsequent cases);
  • actions before The Pension Regulator;
  • cases before The Pensions Ombudsman.

Tolley’s Pensions Law is one of the authoritative texts on pensions law in the UK. LexisNexis describes it as ‘a comprehensive commentary written by a team of legal and tax experts in the pensions field. It provides clear information on the legal and technical aspects of operating pension schemes, as well as giving guidance and explanations on a large range of issues‘.

About the authors

Jennifer Seaman is a leading Junior in the field of Pensions in Chambers & Partners and in The Legal 500 and is appointed to the Attorney General’s B Panel. Jennifer’s practice has a particular emphasis on pensions, trusts and probate disputes, contractual and commercial disputes.

She regularly appears as a sole advocate in the High Court. She has also appeared, as junior counsel, in the Court of Appeal and in the Supreme Court. Similarly, Jennifer acted in two high-profile Supreme Court cases: Futter v HMRC [2013] UKSC 26 (trustee powers and mistaken dispositions) and Benedetti v Sawiris [2013] UKSC 50 (restitution and quantum meruit awards).

Her recent cases in pensions law have included wide-ranging issues such as: the professional negligence of actuaries and solicitors; the interpretation/construction of pension schemes and trusts; the rectification of pension schemes and trusts; probate disputes; inheritance act claims; breach of trust and the nature and exercise of trustee powers. She has also acted for the Pensions Regulator.

Victoria Brown is a civil and commercial practitioner with a particular focus on pensions, employment, commercial and financial services disputes.

Victoria is developing a broad practice in pensions and has advised in relation to construction, rectification, misrepresentation and exercise of powers. Victoria is also the co-author of the War Pensions chapter in Atkins Court Forms.

Victoria has completed secondments at the Pensions Ombudsman and a leading national firm in their pensions litigation team. She has gained a range of experience in pensions disputes across a range of schemes from SIPPs/SASSs to statutory schemes, dealing with issues such as pension sharing orders, the Imperial duty, misrepresentation, ill-health and the exercise of discretions/powers. Victoria has since been instructed by the Ombudsman in a long-running project.
