In his article, Louis analyses the complex legal and moral considerations of transgender athlete participation in sport, particularly in competitive environments.

Louis’ legal analysis focuses on section 95 of the Equality Act 2010, which provides exemptions allowing organisers of gender-affected sports to restrict participation where necessary to ensure fair competition or competitor safety. Last year, in For Women Scotland Ltd v The Scottish Ministers [2025] UKSC 16, the Supreme Court clarified that, in this legal context, “sex” refers to biological sex, meaning organisers of certain sports may lawfully exclude transgender athletes where justified. He also examines other legal cases including Haynes v Thomson to consider whether biological differences such as physical strength, stamina, or physique would or could create an advantage and justify exclusion in specific sports to maintain fairness.

He emphasises that athletic ability varies widely across all individuals and that transgender athletes, like any other group, are not a uniform category in terms of performance. Governing bodies must balance inclusion with fairness and safety for competitors. Determining participation rights will depend heavily on the nature of each sport and whether biological differences create competitive advantages.

To conclude his analysis, Louis notes that this remains a developing area of law and policy, and future decisions will continue to shape how fairness, inclusion, and legal rights are balanced in modern sport.
