After securing as sole counsel a summary judgment before the English courts for the Romanian airline company Dan Air against the Nigerian company Arik Air, Lucian secured another successful outcome before the English Commercial Court in the matter Blue Air Aviation against the Senegalese Groupe Transair, in which judgment was entered by Mr. Charles Hollander KC on 18 December 2024.
The EUR 2 million dispute revolved around the lease of an aircraft engine by Blue Air Aviation under a lease agreement incorporating the IATA Document No. 5016-01 (Master Short-Term Engine Lease Agreement, 2012 Revision).
Lucian assisted the Claimant in its claim for payment of outstanding rent, payable until effective redelivery of the engine. He further successfully argued on behalf of Blue Air Aviation that Groupe Transair pay damages in lieu of its obligations to redeliver the engine at the level of the contractually agreed value of the engine in the event of “Total Loss”. The Court also awarded the Claimant its costs in full on a summary basis.
