Christopher Wilson-Smith KC and Ben Bradley (instructed by Alison Brooks of Barratts Solicitors, Nottingham) recently obtained a significant award for a Latvian National who was injured in a road traffic accident whilst working in the UK. The claimant suffered very severe injuries, chiefly in the form of a traumatic brain injury and a skull fracture. The Claimant took the decision to return to Latvia. High-profile case discussed in APIL’s PI Focus

Mark Pollock, a blind adventure athlete and well-known motivational speaker, is now paraplegic after falling through a second floor window of a residential property. Instructed with Christopher Wilson-Smith QC by Ben Rogers, Partner at Stewarts Law, Matthew Stockwell acted for Mark Pollock in his successful claim against the householders’ insurer. The trial attracted widespread media attention in the UK and Ireland. The case raised a number interesting issues, in particular the duties owed to disabled visitors by an occupier, which are discussed in an article co-written by Matthew and Ben Rogers. Christopher Wilson-Smith QC & Nathan Tavares successful against Health Trust

Christopher Wilson-Smith QC and Nathan Tavares successfully obtained substantial damages against a Health Trust for a claimant who sustained permanent paraplegia following delayed diagnosis of a spinal abscess. Quantification of the Claimant’s case presented a number of challenging problems because of his drug dependency and associated loss of capacity. The Judgment can be read here.

Outer Temple is pleased to support the SIA Solicitors’ Training Conference

The Spinal Injuries Association will hold its solicitors’ training conference on Thursday 22 October at Glazier’s Hall by London Bridge, SE1. Aimed at solicitors and barristers practising in personal injury work, the conference will include sessions on working with children and young people with SCI, and becoming spinal cord injured at an early age. The conference will be chaired by Christopher Wilson-Smith QC. Matthew Stockwell and Sarah Crowther will discuss selecting and managing expert witnesses, while John McKendrick and Katarina Sydow will make a presentation on education needs for children with a SCI. Christopher Wilson-Smith QC and Matthew Stockwell secure damages for blind adventure athlete paralysed by a fall

Instructed by leading litigation firm Stewarts Law LLP, Christopher and Matthew advised and represented Mark Pollock throughout his claim, obtaining judgment following a “difficult” five-day trial before William Davis J. Unbroken by blindness at 22, Mark competed in ultra endurance races across deserts, mountains, and the polar ice caps including an epic two month expedition race to the South Pole. He won silver and bronze rowing in the Commonwealth Games. Describing Mark, the Judge said: “His athletic achievements would have been notable for someone without disability. Given his blindness they were and are remarkable”. The judgment provides much needed security whilst Mark continues his journey, now as a pioneer exploring the frontiers of spinal cord injury recovery.
