David Westcott QC in successful action for Claimant in Harris v Miller

David Westcott QC successfully acted for the Claimant in Harris v Miller [2016] EWHC 2438 (QB). The Claimant was 14 years old when she fell off the Defendant’s horse and sustained paraplegia. An action was originally brought in negligence and under the Animals Act 1971; but since, on the particular facts of the case, the Claimant could not have succeeded in the statutory claim if she failed at common law, only negligence was pursued at trial. The facts were hotly disputed by the parties. It was the Claimant’s case that the horse bucked whilst cantering on flat ground, whereas the Defendant suggested the horse had dipped its head when walking downhill. David Westcott QC & Rachel Vickers successful in Clinical Negligence trial

David Westcott QC and Rachel Vickers recently received judgment in favour of their Claimant client after a five day Clinical Negligence Liability trial. The Claimant was born by emergency Caesarean section and suffered Hypoxic Ischaemic at birth leading to Cerebral Palsy. Timings in the build up to the birth and cross referencing the Claimant’s medical records were crucial in determining the outcome. Click here for an extended summary of the complex issues involved. How do courts determine care claim quantums?

The Court of Appeal has handed down judgment in Reaney v University Hospital of North Staffordshire NHS Trust. The Court allowed the Defendant’s appeal against a finding of Foskett J that the Trust should be liable to pay the Claimant’s full damages because they negligently worsened the Claimant’s pre-existing condition. David Westcott QC was instructed for the successful Defendant for the appeal alongside Charles Feeny, who had represented the Defendant at first instance.
