Success for the claimants on the central questions of diagnosis and quantification of Military Noise Induced Hearing Loss claims Harry Steinberg KC, Aliyah Akram, and Elliott Courcha of Outer Temple Chambers acted in the landmark military deafness litigation, instructed by Simon Ellis of Hugh James, against the MoD. The High Court has today handed down judgment in the Hugh James Military Deafness Litigation. The decision of Garnham J is a decisive victory for the claimant group. The Court rejected the long-standing CLB and LCB methods and preferred the claimants’ case that military NIHL should be diagnosed and quantified by the rM-NIHL developed by Professor Moore and others. Harry Lambert and Elliott Courcha acted in the Court of Appeal in Taha v Capsugel, an international dispute between two heavyweight pharmaceutical companies. Harry and Elliott acted on behalf of Taha Pharmaceuticals in this high-value product liability claim concerning alleged breach of contract, conspiracy and deceit within the pharmaceutical supply chain. The case was pleaded at over £10M in value. Prior to Harry and Elliott’s instruction, Taha’s claim had been struck out for failure to comply with an unless order requiring them to put down security for costs. Taha then applied for relief from sanctions and subsequently appealed on the basis that payment of the security had been impossible owing to regulatory constraints imposed by the Ministry of Finance in Tunisia. We are delighted to announce that Outer Temple pupils Elliott Courcha and Sophie Hyland have accepted offers of tenancy in Chambers. Their tenancies will commence in September 2025. Elliott and Sophie began their pupillages at Outer Temple Chambers in September 2024 and have recently both accepted offers of tenancies to commence in September 2025.
