DIFCA announces landmark New Digital Assets Law, New Law of Security and Related Amendments to Select Legislation

Outer Temple Chambers’ digital assets, and banking and finance experts advised the DIFCA on innovative new laws on Digital Assets and secured transactions in September 2023, which have now been enacted. The new Digital Assets Law is considered to be ground-breaking as it is the first legislative enactment to comprehensively set out the legal characteristics of digital assets as a matter of property law, to provide for how digital assets may be controlled, transferred and dealt with by interested parties and to introduce an impairment regime that addresses the unique characteristics of digital assets. The new Law of Security is influenced by the UNCITRAL Model of Secured Transactions and significantly enhances DIFC’s securities regime to keep pace with international developments…

Alex Haines and Henry Reid were instructed by the Applicant in a case that came before the African Union (“AU”) Administrative Tribunal for a final hearing on 16th and 17th November 2023. The AU Administrative Tribunal, an international administrative tribunal – similar in nature to both the World Bank Administrative Tribunal and United Nations Dispute Tribunal – is based in Addis Ababa, Ethiopia. Judgment is expected early next year.

Henry Reid in conjunction with Chloe Bell of 3 Verulam Buildings successfully resists the enforcement of an arbitral award in the English Commercial Court on grounds of public policy Henry Reid of Outer Temple Chambers acted in conjunction with Chloe Bell of 3 Verulam Buildings for Mr Maxim Chechetkin against US and UK entities associated with the prominent cryptocurrency exchange ‘Kraken’. The claim was brought under s.26 FSMA 2000 in respect of the sale of certain products in breach of the general prohibition created under FSMA 2000. Henry, together with Chloe, acted at all stages of the claim successfully opposing the Defendants’ challenge of the High Court’s jurisdiction [2022] EWHC 3057 (Ch) and other injunctive applications.
