Last week, the International Injury Team at Outer Temple Chambers welcomed Instituto Marítimo Español to Chambers as part of their legal study trip to London. Instituto Marítimo Español is an institution dedicated to maritime training in its various branches across the Spanish speaking world; in legal, technical, commercial and operational functions. The two day trip to London consisted of a number of stops for the IMO team and the students of their Master’s Degree in Business and Maritime Law, as well as their education partners, and we were delighted to be involved. The Royal Court of Guernsey recorded its highest ever personal injury damages award in the case of JG v AC. Gerard McDermott KC and Ian Denham, instructed by Stewarts, represented JG who sustained a complete spinal cord injury, resulting in tetraplegia. In November 2021, JG was a rear seated passenger in a VW Golf that was travelling in excess of the 25mph limit on a narrow road in Guernsey. The vehicle lost control and clipped a wall on the side of the road colliding with a pole, before being flipped upside down and coming to a stop on its roof. Clinical negligence and international injuries specialist, Ian Denham, co-authored an article, “Medical Tourism and Package Travel Regulations” with Polina Sokolovska (formerly of Stewarts), which was recently published in the Journal of Personal Injury Law. The article considers whether medical procedures and treatments could fall within the scope of the Package Travel Regulations and, if so, what guidance there may be establish by what standards such treatment should be assessed and whether liability might be established against a tour operator. Medical tourism is an expanding global industry with a growing number of UK residents traveling to undergo medical and cosmetic procedures abroad. Outer Temple’s Ian Denham has succeeded in obtaining judgment for his client at a preliminary issue High Court trial arising from a high-speed collision on a country lane between two racing vehicles. Ian Denham has succeeded in obtaining judgment in this preliminary issue which concerns a high-speed road traffic collision. The two vehicles were driven by a Mr Angelov and Mr Atanasov. The cars collided resulting in the death of Mr Angelov and with Mr Atanasov and the occupants of the vehicle driven by Mr Angelov sustaining serious injury. Both drivers were found equally culpable for the collision. Ian was instructed to act for Mr Atanasov in Yordanov v Vasilev and Atanasov v Vasilev [2024] EWHC 1496 (KB). He was instructed…

Ian Denham successfully acted for the Appellant in this Court of Appeal case that brings clarity to the requirement to apply to increase the statement of value. This was the Appellant’s second appeal against an order that denied him permission to increase the value of his claim for damages for personal injury. The judgment also provides clarity as to the scope of CPR rule 16.3(7). Ian acted for Mr Fleming, who had previously been acting in person, on a pro bono basis through Advocate.
