Ian Denham instructed in inquest after fatal infections at Royal Papworth Hospital

Ian Denham represents the families of two women after they contracted fatal infection from a hospital’s water supply

Ian Denham has been instructed to represent the families of two women who died following an outbreak of the Mycobacterium Abscessus pathogen at the Royal Papworth Hospital. Ian Denham has been instructed by Jatinder Paul, Senior Associate Solicitor in the International Serious Injury team at Irwin Mitchell, and his colleague Jennifer Hodgson to represent the families of two women who died in an inquest following an outbreak of the Mycobacterium Abscessus pathogen at the Royal Papworth Hospital in Cambridge. The background Karen Starling, aged 54, and Anne Martinez, aged 65, both tested positive for Mycobacterium Abscessus (MA) after successfully undergoing double lung transplants at the Royal Papworth Hospital. Travel Law Conference – Talk 3: Running PI claims North and South of the Border

Outer Temple Chambers hosted a Travel Law Conference which included a number of topical talks on international injury claims. The third in a series of four talks was given by Ian Denham (Outer Temple Chambers) and Simon Richards (Digby Brown). Ian Denham announced as Representative for England & Wales on the PEOPIL General Board

We are pleased to announce that Outer Temple barrister Ian Denham has been appointed as the new Representative for England and Wales on the PEOPIL General Board. On Thursday 15th September 2022, PEOPIL announced their new General Board members on the eve of the Annual Conference in Copenhagen. Ian succeeds Philip Mead of 12KBW who steps down after completing his time in this role. Ian will continue to represent the interests of PEOPIL members from England & Wales, which has one of the largest memberships by country. The Board is presided over by Spanish lawyer Ana Romero. Scott v AIG: The scope of article 4(3) Rome II and the meaning of “the tort/delict”

Ian Denham recently acted for the successful respondent in an appeal concerning the scope of article 4(3) of the Rome II Regulation. The Claimant had been on holiday in France when she was involved in a road traffic accident with an uninsured vehicle. An issue arose as to whether the claim against the motor insurer of the vehicle in which she was travelling was governed by English or French law. In this article, Ian reviews the judgment of HHJ Platts in Scott v AIG which provides a helpful summary of the existing case law on article 4 of Rome II and considers what is meant by the term ‘the tort/delict’ when weighing whether article 4(3) should displace the presumptive applicable…

On 15 and 16 October 2021, the Annual Conference of the Pan European Organisation of Personal Injury Lawyers was held in Málaga, Spain.  This was the first conference held by PEOPIL since the pandemic started. Challenging expert evidence in cross-border claims … where next?

Ian Denham looks back on the High Court decision of Griffiths v TUI UK Limited and considers the impact it has had on cross-border personal injury claims. Since the judgment in August 2020, defendants have sought to find new ways to challenge expert evidence. This has included seeking permission for their own expert evidence or calling the claimant’s expert to be cross-examined at trial. The results of these applications have varied from court to court.
