James Smith’s case note on the recent Supreme Court sanctions law case published in the JIBFL

James Smith has been published in the October 2025 edition of Butterworths Journal of International Banking and Financial Law, with a case note on the recent Supreme Court case, ‘Shvidler v Secretary of State for Foreign, Commonwealth and Development Affairs’. James’ article analyses a landmark judgment of the Supreme Court relating to the United Kingdom’s sanctions regime. The case involved Eugene Shvidler, a Russian businessman who was designated under the Sanctions and Anti-Money Laundering Act 2018 following Russia’s invasion of Ukraine. Mr Shvidler challenged his designation as disproportionately interfering with his private life under Article 8 of the European Convention on Human Rights and as affecting his right to property under Article 1 of the First Protocol of the Convention. James Smith has written an article titled ‘Russia sanctions and the prohibition on trust services’ for the latest journal article of Trusts & Trustees, published on 9th July 2025. UK sanctions law contains a prohibition on the provision of trust services to or for the benefit of designated persons and persons connected with Russia. This article analyses the background to and legal framework of the prohibition. The article then looks at the application of the prohibition to Crown Dependencies and Overseas Territories, before considering practical steps for affected practitioners. It concludes that a prohibition on trust services is likely to be a lasting feature of the UK’s sanctions regime, posing significant compliance challenges for the trusts industry. Read the full…
