John McKendrick QC represents GP in Skype-only trial

John McKendrick QC is representing a GP in a trial conducted solely over Skype in response to the Covid-19 pandemic. The Law Gazette stated that this is a legal first… Lawyers have stated this could be a model way to ensure court business continues during the Covid-19 pandemic. Mr Justice Mostlyn decided that the hearing should be conducted over Skype to enable it to proceed without risking the health of any of the participants, some of who are in vulnerable groups or live with people who are. John represented the GP of a man in his 70s who suffered a major stroke in 2016 in the Court of Protection case. The trial will decide whether it is in his best…

John McKendrick QC has been invited to talk at the The ILS Global Forum on International Law hosted by iLaw2020 on February 28, 2020. John will speaking on a panel for the plenary session titled ‘U.S. Sanctions Policy and OFAC: What Every Lawyer (and Client) Should Know’. The unofficial theme of this year’s conference is International Corruption. The session will explore how U.S. sanctions policy has evolved over the last three decades, the significant role it plays in Latin America, beginning with the Cuba Embargo, Kingpin Act in Venezuela, and – most recently – the sanctions imposed on the Maduro Regime in Venezuela. John has been invited by the Bahamas Bar Association to address local attorneys on the regulation of Fintech at an evening seminar on 30 January 2020. As the Attorney General of Anguilla between 2016 and 2018, John was responsible for the Anguilla Utility Token Act, one of the world’s first legislative attempts to regulate virtual currency and utility token offerings. OTC’s International Law Team on the effect of Brexit on the UK Sanctions Framework

Following John McKendrick QC and Alex Haines’ successful sanctions seminar – in conjunction with Central America’s largest law firm Consortium legal – in Managua on 30 August 2019, the Association of Certified Sanctions Specialists (ACSS) has published their article The ‘Nica Act’: The Nexus, Effect, and Long-Arm Reach of US Sanctions Against Nicaragua on its website. The Nicaraguan Human Rights and Anticorruption Act of 2018 (NHRACA) seeks to hold violators of human rights and corrupt actors in Nicaragua accountable. John McKendrick QC and Alex Haines will be in Panama, Nicaragua, Mexico and Colombia between 28th August and 5th September 2019. John McKendrick QC succcessfully acts in Court of Appeal termination case

John recently appeared for the appellant in the Court of Appeal challenging a first instance declaration that a termination at 23 weeks was lawful and in an incapacitated woman’s best interests. The appeal was heard urgently the day before the termination was due to take place. The Court of Appeal, McCombe, King and Peter Jackson LJJ granted permission to appeal, allowed the appeal and dismissed the NHS Trust’s application. The Judgment can be found here. John McKendrick QC and Chloë Bell to advise the Inter-American Development Bank

John McKendrick QC and Chloë Bell are instructed to advise the Inter-American Development Bank in respect of legal and regulatory issues arising from their work in Jamaica on state modernisation. John and Chloë will be in Kingston during the week of 8 July 2019 to assist in a workshop with senior Government officials and will hold meetings with the IDB and other experts. Outer Temple barristers John and Chloë both work in the area of constitutional law and Chloë is a former judicial assistant to Lord Mance and, was involved in Privy Council matters. John has carried out development work for the IDB in the past and has a long history of working in the Caribbean.

John McKendrick QC acts for NHS trust in High Court Jehovah’s Witness case

John McKendrick QC is currently acting in the High Court, London for an NHS trust responsible for the treatment of a 17 year-old Jehovah’s Witness. The boy, who has leukaemia and who lives in the south east of England, has refused potentially life-saving blood product treatment for his condition, because of his religious beliefs. NHS trust doctors are respecting the boy’s views and doctors are not treating him with blood products. Lead barrister for the trust, John McKendrick QC said that the boy had refused to consent to treatment involving “blood products” and that the teenager was “extremely articulate about his Jehovah’s Witness faith”. Advocacy training at the DIFC Academy of Law, with Keith Bryant QC and Jonathan Hand QC

As part of the newly-created Certificate in Common Law and DIFC Courts Practice, Keith Bryant QC and Jonathan Hand QC have successfully delivered training on Appeal Advocacy and judged the final Advocacy Assessment Exercises for students at the DIFC Academy of Law in Dubai. The group was made up of some twenty aspiring trial lawyers, all of whom have benefitted from three sessions of advocacy training run by Outer Temple barristers John McKendrick QC, James Counsell QC, Fiona Horlick QC and Benjimin Burgher, since the beginning of 2019. John McKendrick QC is speaking at one of the largest gatherings of lawyers from the Commonwealth, organised by the Commonwealth Lawyers’ Association. The 21st Commonwealth Law Conference 2019 is taking place for the first time in Livingstone, Zambia during the week of 8 April, with the theme of “The Rule of Law in Retreat? Challenges for the Modern Commonwealth”. John will speak at two sessions: ‘Developments in Appellate Advocacy’ and ‘Regulation of Competition law’. Other speakers at the event include the Lord Chief Justice, the Lord Justice Clerk and the Secretary General of the Commonwealth.
