John McKendrick, instructed by Hannah Taylor of Bevan Brittan, appeared for the applicant health bodies and local authority in complex proceedings before the Court of Protection to declare a patient lacks capacity to make decisions about the place and mode of delivery of her unborn baby and to declare that it is in her best interests to be the subject of a placental location scan, forced caesarean section and to receive contraception following the birth of her child. John McKendrick has been invited by the Inter American Development Bank to speak on the subject of “Effective Oversight of Procurement” at their major regional conference entitled: “Public Procurement: A strategic Government Tool for Efficiency and Prosperity”. John will be speaking with a line up of distinguished speakers to an audience of mostly Caribbean public officials and private sector representatives. The conference takes place in Port of Spain on Monday 23 June 2014. John last visited Trinidad as part of a Caribbean visit for the Foreign and Commonwealth Office when he addressed issues of transparency, corruption and anti-bribery measures in a number of Central American and Caribbean jurisdictions. Between 13 and 15 January, John was working in El Salvador as a guest of the British Embassy. He made a number of presentations on the rule of law, anti corruption measures, the UK Bribery Act 2010 and the EU Central America Association Agreement. He met with the Minister of Public Works, the Presidential Sub-Secretary responsible for transparency and many other state and civil society representatives. John also gave a presentation to the British School in San Salvador. John successfully acted for EDI Plc resisting an appeal against a decision to strike out and grant summary judgment against a counterclaim for damages in the case of DCAS Business School v EDI Plc [2013] EWHC 3378 (QB). At the relevant time EDI Plc was a private company that acted under a statutory scheme as quasi regulator of providers of national vocational qualifications. DCAS Business school, which purported to offer such qualifications, counterclaimed against EDI in breach of contract and in negligence for the manner in which EDI regulated DCAS’s business. DCAS claimed it had suffered significant financial loss. EDI applied to strike out the counter claim and sought summary judgment. This was granted. DCAS appealed to the High Court.…

John McKendrick, instructed by Weightmans solicitors, has appeared for the local authority in a ground breaking case before the Court of Protection. Today, Mrs Justice Eleanor King has made legal history by granting an application for a declaration that it is lawful and in the best interests of an incapacitated adult to undergo a non therapeutic sterilisation. This is believed to be the first time a court in this jurisdiction has approved such a procedure being carried out on a man who is incapable of consenting. John recently acted for a local authority in proceedings before the Court of Protection which determined that sterilisation would not be in the best interests of a young learning disabled woman. John McKendrick is speaking at the 2013 Americas & Caribbean Forum on Financial Crime Prevention in Panama City. The event which will take place at the Hotel Riu Plaza, Panama City, 14 – 18th January 2013 focuses on the need to balance a growing and dynamic economy with a stable and judicious regime for financial crime prevention. John will present an afternoon session on “Understanding the structures used in Financial Crime: trusts, foundations, companies and nominee agreements”. John is also speaking at two panel sessions, one of which will focus on the role of the private sector in combating corruption and the other will focus on boardroom support for measures necessary to prevent financial crime in large organisation.

Following his successful presentation on the Bribery Act 2010 hosted by the British Embassy in Panama in January, Outer Temple Chambers’ barrister John McKendrick embarked upon a visit to Costa Rica and Nicaragua where he gave a series of seminars in English and Spanish on the power of transparency to overcome corruption and the importance of the rule of law in stimulating economic development.

Chambers is pleased to announce John McKendrick has been appointed as standing junior counsel to the Advocate General for Scotland. The Advocate General, Lord Wallace QC, is the UK Government’s principal legal officer in Scotland. John will work mostly for the Secretary of State for Home Department. John is uniquely placed to act as junior counsel for the UK Government on both sides of the border: he was appointed to the Attorney General’s ‘B’ panel of counsel earlier this year.
