James Counsell KC to attend the DIFC Laws Certificate Programme Awarding Ceremony

Head of Chambers, James Counsell KC will be attending (remotely) the DIFC Laws Certificate Programme Awarding Ceremony on behalf of Outer Temple Chambers on Tuesday 13th December 2022. The DIFC Laws Certificate Programme is a course organised by the DIFC Academy. Over the course of a 7-month programme, it aims to provide education and training in common law and DIFC laws and courts procedures to civil law lawyers, DIFC Courts practitioners, Emirati advocates, In-house counsel and other professionals whose work involves exposure to common law systems and jurisdictions. There are three parts to the Advanced Advocacy course given by Outer Temple Chambers barristers, each part over two days. Jonathan Hand KC and David Holloway lead the third Advanced Advocacy session for the DIFC Academy

Outer Temple’s Jonathan Hand KC and David Holloway lead the third Advanced Advocacy session for the DIFC (Dubai International Financial Centre) Academy on the 10th and 11th of October 2022. Jonathan Hand KC and David Holloway were the course tutors for the last of the three Advanced Advocacy sessions that the DIFC Academy put on again this year in association with OTC. The first day dealt with appeal advocacy, including presentations and workshops on written and oral advocacy. The second day was the Advocacy Assessment when all of the participants took part in an oral hearing held at the DIFC Court. Court approves settlement of over £22 million in birth injury claim

Jonathan Hand QC, instructed by CL Medilaw, represented the Claimant who suffered severe brain damage at the time of her birth. In this case, liability had already been settled on the basis that the Claimant would receive 90% of the full value of the claim, leaving the amount of compensation to be decided by the Court. Following further consideration of the claim, the High Court approved a settlement with a capital value of over £22 million (equivalent to over £24.5 million on a full liability basis). The settlement was structured so as to allow the Claimant to receive periodical payments for care and case management for her lifetime. Jonathan Hand QC successfully represented the Claimant in this clinical negligence claim, in which judgment was given on 9 November 2021. The following is a summary of the judge’s decision in the case.  The claim was brought on behalf of Mrs Miller’s estate together with a claim by her husband and her half-brother, as dependents under the Fatal Accidents Act 1976 after Mrs Miller was involved in a serious road traffic accident in 2016. The background In the accident, Mrs Miller suffered multiple orthopaedic injuries, including multiple fractures. Following arrival at the hospital by air ambulance, Mrs Miller underwent surgery for the fractures and was admitted to the ICU. Several weeks later, by which time Mrs Miller’s condition appeared to…

Members of Outer Temple will be providing advocacy training at the DIFC Academy for pupils completing the Common Law Advanced Advocacy Skills. The DIFC Academy of Law have launched this course for Emirati Advocates and other civil law trained lawyers, in-house counsel, and legal professionals seeking to diversify their skills and enhance their professional development. This will be the third edition of Advanced Advocacy Skills as part of the Certificate in Common Law, DIFC Laws & Courts Practice programme that Outer Temple has contributed to.
